1 RESOLVED, that, upon the petition of the Amherst H. Wilder Foundation, as documented in Real
2 Estate Division File Number 16-2001-A, public properties hereinafter described aze hereby vacated and
3 discontinued as public property:

5 The alley located west of the southerly extension across it of the east line of Lot 9, Victoria &
6 Lafond St. Add., and the north-south alley located west of the southerly extension across it of the
7 east line of Lot 1, Block 1, in The House of Good Shepherd's Addition, Saint Paul, Minnesota;
9 This vacation shall be subject to the terms and conditions of Chapter 130, codified March 1, 1981, of the
10 Saint Paul Legislative Code as amended, and to the following conditions:

1. That the petitioners, their successors and assigns shall pay $500.00 as an administrative fee for
this vacation which is due and payable within 60 days of the effective date of this resolution.
2_ That an alley turn-around area shall be dedicated and construction done in accordance with a plan
approved by the Department of Public Works.
3. That a sewer easement sha11 be retained within that portion of the alley abutting Lots 9 and 10,
Victoria and L,afond Street Addition. The Department of Public Works reserves the right of the
City to maintain and operate any sewer in or upon said easement and to enter upon said easement
or any portion thereof at any ume and from time to time, for the purposes of future construction,
reconstruction, inspecung, maintaining or repairing the same or any part thereof. Said utility
easement shall be subject to the following conditions:
a. No buildings, structures, trees or any temporary structure, material storage, fixture, or any
other objects that will prohibit normal access to uuliry facilities for maintenance purposes
will be permitted within the easement area.
b. Improvements in or upon the above described easement that do not prohibit the City from
exercising its reserved rights may be allowed by obtaining written permission from the
Department of Public Works Sewer Division with the understanding that the restorauon
and costs of such improvements shall be the sole responsibility of the petitioner, its
successors and assigns in the event the City exercises its reserved easement rights.

No change from the e�sting grade within the easement azea will be permitted without
written permission from the Department of Public Works.
No change in surfacing within the easement area will be permitted without written
permission from the Department of Public Works.
An encroachment permit can be issued for the petitioner's pazking lot improvements within the
easement azea.
4. That the peutioner shall be responsible for the reconstrucuon of the public right-of-way at both
ends of the vacated azea, to properly eliminate the appearance of a public thoroughfaze,
including, but not limited to, costs for new curbs sidewalks, storm drains, and signs, all to the
satisfaction of the Department of Public Works.
5. That the peutioner shall be required to obtain site plan approval from the Department of Public
Works within the City site plan approval process, for their proposed pazking lot improvements
within the vacated area.
6. That the petitioners, their successors and assigns agree to indemnify, defend and save harmless
the Ciry of Saint Paul, its officers and employees from all suits, acuons or claims of any character
brought as a result of injuries or damages received or sustained by any person, persons or
property on account of this vacation or petitioners' use of this property, including but not limited
to, a claim brought because of any act of omission, neglect, or misconduct of said peutioners or
because of any claims or liability arising from any violaUOn of any law or regulauon made in
accordance with the law, whether by the petitioners or any of their agents ar employees.
7. That the petitioners, their successors and assigns shall, within 60 days of the effecuve date of this
resolution, file with the City Clerk an acceptance in writing of the conditions of this resolution
and sha11, within the period(s) specified in the terms and conditions of this resolution, comply in
all respects with these terms and condiuons.
