WHEREAS, the City of Saint Paul has undertaken a condemna-
tion of that certain property described as Rice-Arlington Proposed
Recreation Area, Project No. Minn. OSA-41, and under Resolution of
the Council , Council File No. 245404, approved August 2'7, 1g69,
did allow a total amount of �345,000. 00 as damages to the Twin
Plaza Co. ; and
WI�REAS, the Twin Plaza Co. did appeal to the Ramsey County
District Court from said award and , pursuant to Resolution, Council
File No. 24g847, approved July 24, 1970, a partial payment of the
damages so awarded was made to the extent of �258,750.00, pe.nding
the determination of the appeal ; and
WHEREAS, the City of Saint Paul and the Twin Plaza Co. did
thereaYter settle and compromise the issues, thereby increasin.g
the total amount of damages for said taking to the sum of �500,000.00,
such settlement including all claims of in.terest and principal on
said sum, but not including a claim for property taxes and assess-
menta in the amount of �7,777 .7�, which claim rem ains to be deter-
mined by opinion of the Attorn�y General of the State of Minnesota
and�or of the office of Corporation Counsel , and pursuant to othcr
reeourses of the Twin Plaza Co. as the law may permit; and
WHEREAS� the Department of Housing and Urban. Development haa
,� concurred in the settlement and has agreed to execute a consent to

� RESOLVED� that the pr oper City officers are authorized and
o directed to pay the balan.ce of the award and the increase as
� ;� compromis�d to the total extent of �241,250. 00, such payment to
be made from the PIR Fund 60Q0-501, the increase over the funds
presently retained by the City of Saint Paul to be reimbursed from
the Department of Housing and Urban Development or� in the alternative,
from the i968 CI$ Restricted Use Fund upon the dismissal of the

Re: Rice Arlington Acquisition Project OSA-41 ,
The City of Saint Paul, after rather lengthy and involved negotiations, I
has reacl�ed a settlement with the former owners of Che above described ,.,
acquisition project in the amount of $500,000. This amount represents an
increase of $155,000 over the original appraisals of $345,000. We hereby '
request that this Rice-Ar13.ngton compromise settlement be paid from P.I.R.
Account No. 6�00-R (L-7147) . The financing for this pro�ect is a$ follows:

event that the additional H.U.D. funds do not materialize, this department
will pay the additional sum necessary from the 1968 C.I.B. Restricted Use Fund.

abutting said Lot D, Soo Line Plat Number 2, which
accrued to said Lot D upon vacation, according to
the plats thereof on file and of record in the
office of the Register of Deeds in and for Ramsey
County, Minnesota;
in and by that certain public improvement proceeding instituted,
conc�ucted and completed therefor by said City under applicable
provisions of its Home Rule Charter, in the matter of condemning
and taking said property for playground purposes, described in
said prior resolution; that hereby said Council appropriates and
sets aside in the Treasury of said City, in a trust fund therein
to be known as The Condemnation and Award Fund, a sum equal in
amount to said award of damages, to-wit: the sv.m of $345,000.00,
and does hereby provide for the retention thereof therein during
, said appeal, it being understood that Twin Plaza Co. , a corporation,
is to execut� a stipulation for a court order of the Ramsey Coun�y
District Court directing the release of $258, 750.00 of said mon�y,
and, in view of the needs and purposes of said payment, the proper
City officers are authorized and directed to enter into said
� stipulation for the release of said $258, 750.�0 upon said party
furnishing a warranty deed and proper evidence of title to the
City, in form approved by the Corporation Counsel= that upon
receipt of said court order, the proper City officers are di-
rected to pay $258,750.00 to Twin Plaza Co. upon the presentment
of said deed and proper evidence of title; that the balance shall
