1 WHEREAS, on July 24, 2002, the Council approved CF# 02-691, vacating part of the east one-half of Block 5, Stinson, Brown and
z Ramsey's Addition, and part of Toronto and Daly Sueeu; and
3 WHEREAS, approximately 6,000 squaze feet of the property vacated thereby described as:
a that part of Toronto street lying south of a line 65.00 feet southerly of and para11e1 to the north line of said Section 12, easterly of the

5 Beginning at a point on the centerline of St. Clair Avenue in St. Paul, distant 124.99 feet easterly of the Northwest Comer

i� and the proper City officials aze hereby authorized and directed to dispose of the said property as provided in Chapter 51 of the
1a Adminisuative Code.
19 BE IT FURTFIER RE50LVED, that, as provided in Pazagraph 13.01.1. of the Ciry Charter, the purchaser of that said part of
zo vacated Toronto Street shall pay full mazket value, as established by independent appraisal, to the Department of Pazks and
Recreation, and shall reimburse the City for the cost of the said appraisal.

BE IT RESOLVED, that, upon the peution of the Ciry of Saint Paul, as documented in Real Estate
Division File Number i 1-2002, public properties hereinafter described are hereby vacated and
discontinued as public property; and
5 BE IT FURTHER RESOLVED, that the proper Caty officials are hereby authorized and directed to
6 convey title to all hereinafter described public properties by quit-claim deed, to the Housing and

this vacation which is due and payable within 60 days of the effective date of this resolution.
T'hat the petxtioners, their successors and assigns agree to indemnify, defend and save harmless
the City of Saint Paul, its officers and employees from all suits, actions or claims of any character
brought as a result of injuries or damaaes received or sustained by any person, persons or
properry on account of this vacation or petitioners' use of this property, including but not limited
to, a claim brought because of any act of omission, neglect, or misconduct of said petitioners or
because of any claims or liability arising from any violation of any law or regulation made in
accordance with the law, whether by the petitioners or anp of their agents or employees.

RESOLUTION 02-18
WI-IEREAS, the Saint Paul Parks and Recreation Commission is an appointed body established
to advise the Mayor and City Council on long range and city-�vide matters related to Parks and
Recreation; and
WFIEREAS, the City of Saint Paul earlier vacated and sold certain unimproved street right-of-
way known as Toronto Street, between Grace Street and the Osceola Connection abutting the west
boundary of the West Seventh Community Center, and
Wf-IEREAS, the City has received a petition from the Housing and Redevelopment Authority for
vacation of properties, including that as yet unvacated part of Toronto Street right-of-way between Grace
Street and the Osceola Connection and abutting the west boundary of the West Seventh Communiry
Center, to enable development of the adjoining site for the purpose of constructing a 90 unit senior
citizen housing facility at this location, and
WHEREAS, the petitioner has further requested that the part of Toronto Street east of the
centerline, which will accrue to the city's community center site upon vacation, be made available to the
developer to include in the development site, and
WIIEREAS, the City of Saint Paul is in need of expanded affordable housing opportunities for
senior citizens, and
WHEREAS, a senior citizen housing complex at this location would offer the oppodunity for a
cooperative relationship with the West Seventh Community Center; and
WIIEREAS, the West Seventh/Fort Road Federation supports the sale of vacated Toronto Street
to the petitioner and development of a senior citizen housing facility at this location;
NOW, THEREFORE, BE IT RESOLVED, that the Saint Paul Parks and Recreation Commission
concurs with the request of the Housing and Redevelopment Authority that the developer be permitted to
acquire the remaining right-of-way east of the centerline of vacated Toronto Street between Grace Street
and the Osceola Connection.
