Marshall � City Clerk r Room 386 City Hall St. Paul, Minnesota 55102 , Dear Sir: This is written in response to the appeal by The Lennon Company to relax den- sity and setback requirements on property located on the southeast corner of West Morton Street and Ohio Street and further described as: Lot 1, Block 17, Dawson's Addition This appeal was considered by the Zoning Board at its October 21, 1971 public I hearing at which time the staff report was read. The staff reported finding no hardship concerning the property. The appellant stated that the present structure occupied by one family would be remodeled to accommodate a second family. In discussion it was noted that the structure was a legal non-conforming use as a commercial use in a residential area and that it would, appear to be more acceptable as a residence. Subsequently, the Board heard a motion to recommend approval. The motion was seconded and carried by a vote of 4 to 0. (Property information, Page #3, at- tached hereto) . There is a two story building on the lot, which at one time operated as a neighborhood grocery store with a (2) bedroom apartment on the second floor. The first floor has been vacant for over two years now, with boarded windows and a poorly kept lot. (See Exhibit "C" , pictures 2 and 3, attached) . The apartment is presently occupied. The owner cannot afford to main- tain this property and his present business and therefore wishes to sell this property. I have a responsible purchaser who would convert this building into a duplex which could offer two excellent apart- ments units to this extremely good neighborhood. (See Exhibit "B" picture #3 , attached) . A similar building was converted at 805 Ohio Street. (See Exhibit "C" , picture #1, attached) , and has proven a genuine asset to this neighborhood. HISTORY: In 1949, an appeal for an extension of a legal non-conforn►ing use on this site in order to demolish the existing building and build an entirely new building for a commercial use was determined by the Zoning Board to be a proposal beyond the limits authorized by the Zoning Code for an extension of a legal non- conforming use. The Board reco�anended denial. There is no record of Council action on the matter. C. PROPOSAL: The appellant proposes to develop the existing structure into a duplex. D. NEED FOR APPEAL: The site is short of the area required for a duplex in an "A" residential district. The existing building does not meet the setback requirements for a structure in an "A" residential district. F. PRESENT STANDARD: A duplex requires an area 7,500 square feet. The setback for this lot is 26 feet. Fo VARIANCE: The appeal requests a variance of 1,000 square feet or 13.2% on density and 26 feet or 100% on setback. Go AREA ZODTING: There is a small "C" Residential district one block north of this site, The rest of the area is "A" Residential. The Comprehensive Plan calls for low density residential use of this area. Ho SITE CONDITIONS: The site is occupied by what appears to be a structure built as a neighborhood grocery store with a dwelling on the second story. The lower floor now appears to be vacant but the second story still appears to be occupied, The structure appears to be built up to the street line of both Ohio and Mor�on Streets. A yard area about 35 feet in width exists to the south of the structure. A larger yard area exista to the rear of the building with a number of trees and an eventual slope downward to the east where a chain link fence exists along what appears to be the property line. The lot is about at street grade and no curb adjoins the property. I. AREA CONDITIONS: The remainder of the block consists of 14 single-family homes and one duplex, Bryant School exists on the block east of this one. The surrounding area is predominantly single family development with six duplexes in the ei�;ht blocks immediately surrounding the subject block. 9.
