Dear Sir:
This is written in response to the appeal of Wm. F, Svigel to relax area re-
quirements on property located on the northwest corner of Forest and E. Fourth
Streets and further described as:
Lot 32, Daily and Berrisford's Subdivision
, This matter was. heard at the October 21, 1971 Board of Zoning public hearing.
The staff report on file was read.
Mr. Svigel explained that the subject structure now contains two apartment
units but no retail area.
A letter from area residents was read supporting the appeal.
The Board heard a motion to recommend approval. The motion was seconded and
carried by a vote of 4 to 0.

A. HISTORY: There is no record of a zoning history for this site.
B. PURPOSE: The appellant is requesting permission to alter the former retail area of
the structure to a second dwelling unit.
C. NEED FOR APPEAL: The property under consideration does not meet the minimum lot
size for a two-family structure. '
D. PRESENT STANDARD: Chapter 60, Section .24, Density and Land Coverage, sets forth
a schedule of density controls in other than "A," "B," and "C-1" Residential Diatrict.
This schedule aeta the minimum requirementa for a two-family use as 50-ft. width
At ttie lc�gal setback line end 6,000 aq. ft, in area.
E. VARIANCE: This property has a width of 44 ft. which ia 6 ft. or 13.6% short of that
required. The area of this property is 4,485.74 sq. ft. which is 1,514.26 ft. or
25.24% short of the required area.
F. AREA ZONING: The East Fourth SCreet frontage in this area is zoned Commercial. The
adjoining area north and south of the conanercial frontage is zoned "C" Residence.
The rest of the area is zoned "B" Residence.
G. SITE CONDITIONS: The site is occupied by a building built to the property lines along
Forest and Fourth Streets. It faces Forest Street. A paved area immediately behind
the structure appears capable of containing one car with access to Fourth Street.
There is no alley ad,jacent to the aite. There is a backyard containing a small
shecl, a tree, and a hedge. A driveway on the ad�oining property abuts the structure
on its north side.
H. AREA CONDITIONS: The predominant development in the area is one and two family usea.
A stop sign relates to eastbound treffic on Fourth Street at Forest Street.
