Section l. That the Zoning Code, Ch��ers 60 to 64,
inclusive, of the Saint Paul Legislative Code, pertaining to
Use Districts, Height Districts and Rezon�ng of certain prop-
erties in the City of Saint Paul, as amenc�ed, be and the same
is hereby further amended so as to rezone the following des-
cribed property from "B" Residence Distriet to "C" Residence
District, to�wit:
Lots 14 and 15, Block 30,
Arlington Hills Addition; ,
situate on property located on the north side of York between
Arcade and Weide Streets in the City of SBint Paul.
Section 2. This ordinance shall take effect and be in
force thirty (30) days from and atter its passage, approval

Dear Sir:
This is written in response to the petition of Joseph H. Bennett to rezone
from "B" to "C" Residence property located on the north side of York between
Arcade and Weide Streets. This property is further described as Lots 14 and
15, Block 30, Arlington Hills Addition.
This matter was heard at the May 4, 1972, Board of Zoning Public Hearing, at
which time the staff report was summarized. The $taff noted that there does
not appear to be sufficient area for five cars on the property with this
topography and that the alley does not appear to be built to this lot. The
staff noted the site could accommodate six units at "C" Residential density.
Favoring the petition is the fact that the site i$ close to a Commercial
district but opposing the petition is the fact th�t both residentially and
commercially zoned adjoining property is used residentially.
The petitioner explained the proposed use, saying that he now has a duplex
there and wants to put another unit in the basement. He said his proposal
meets all the building code requirements except the ceiling height which he
will appeal. He said he now has two off-street p�rking spaces in the rear
which are reached from the alley and that he has space for five cars.
As the Board discussed this, it was noted that the owner could add still more
units once the property is rezoned. They noted that State legislation pro�ibits
the proposal from being granted by agpeal. It was noted that the Board would
perhaps be in favor of rezoning the more general area to "C" Residential which
would eliminate the question of spot zoning. With the comment that this pro-
posal would not be harmful to the neighborhood, a motion was made to recommend
approval with the understanding that the off-street parking requirements would
not be waived. The motion was seconded and the vote on the motion was 4 to
0 in favor.

A. SUFFICIENCY: In a letter dated April 6, 1972, the Gommissioner of Finance declared
the petition sufficient with i4 of a possible 20, or 70°/� of the owners of the sevexal
descriptions of real estate situated within the prescri ed distance having signed the
petition.
B. HISTORY: A petition to rezone this property to "C" esidence was declared insuffi-
cient on March 16, 1960.
C. PROPOSED USE: The petitioner proposes to alter the existing two family structures to
accommodate three dwelling untis.
D. FRONTAGE & AREA: The property has a frontage of 80' along York Avenue with a depth
of 125 ' resulting in an area of 10,000 sq. ft.
E. AREA ZONING: The frontage along Arcade Street is zoned Commercial, The area south
of this property between York Avenue and Wells Street�fronting on Arcade Street is
zoned Light Industry. The rest of the adjacent area is zoned "B" Residence.
F. COMPREHENSIVE PLAN: The Comprehensive Plan reco�nended medium density for the
area. This area is recommended as an RT-1 District under the proposed zoning code.
G. SITE CONDITIONS: The property is developed with a newer duplex located on the east
portion of the site, The west half of the property has a very steep slope up to the
west rising about 20 feet, in a distance of 20 feet. There does not appear to be
sufficient area for five cars on the property with this topography.
H, AREA CONDITIONS: York Avenue ia curbed and guttered and has a grade of approximately
6.�%, up from Arcade Street to Weide Street. The area ia developed with older residential
structures, mixed one and two family with some conversions to three and four families.
Old Johnson High School '�ocated between Walsh and Weide Street is being used as a school
warehot�se and repair shop. The zoning is "B" Residence. South across York Avenue is a
large parking lot for Whirlpool employees.
