Ware s Cumberland Addition Plat l, according to the plat on file and of record in the office of the Register of Deeds in and for the County of Ramsey, State of Minnesota. WHEREAS, pursuant to resolution, C. F. No. 258354, approved April 27, 1972, a public hearing was scheduled for 10:00 a.m. on Ma.y 17, 1972 before the Council of the City of Saint Paul, said hearing pertaining to the condition of the structure located at 1604 Ma.ckubin, Saint Paul, Minnesota; and WHEREAS, upon facts presented at said hearing consisting of photographs, inspection reports and the recommendations of the City Architect, it is found and determined by the City Council tha.t according to the records and files in the office of the Ramsey County Abstract Clerk, the last record owners of the above described property are Thoma.s J. and Prosper DeLisle; and that there are no other lien holders of record; and that it is further determined that the above described building constitutes a hazardous building within the definition of Minnesota Statutes Section 463.15 for the following reasons: a. The exterior condition of the building is as follows: The roof is burned and charred and the rear addition shows evidence of settling and the roof is leaking; c. The interior condition of the building is as follows: The four rooms on the first floor are heavily damaged by fire. The partition between the kitchen and dining room is missing. The bathroom floor from the second floor is burned out and fallen into the kitchen. The second floor joists are burned out as well as the stairway to the second floor ma.king further inspection of the second floor impossible. The heating, electrical and plumbing systems are heavily damaged by fire. d. The building in the above condition is beyond reasonable repair; e. The building is unfit for human habitation in its present condition and the above corrections must be ma.de in compliance with the Builc�ing Code and the Housing Code of the City of Saint Paul in order to make the same habitable; f. The building constitutes a nuisance and a hazard to the public health, safety and welfare because of its physical damage, dilapidation and inadequate maintenance,• now, therefore, be it RESOLVED, that in accordance with Minnesota Statutes Sections 463. 15 through 463. 26, and based upon the foregoing findings of the City Council, the Council of the City of Saint Paul does hereby make the following Order: ORDER 1. The owner of the above described building shall make the same safe and not detrimental to the public peace, health, safety and welfare by having the said building razed and the ma.terials therefrom removed from the premises within thirty (30) days from the date of the service of this Order; 2. In the event that the building is to be razed by the City of Saint Paul pursuant to judgment of the District Court, all personal property or fixtures which may unreasonably interfere with tlie razing and removal of this building shall be removed within ten (10) days from the entry of judgment; and if not so removed, the City of Saint Paul shall remove and dispose of such personal property and fixtures as provided by law; 4. If the City of Saint Paul is compelled to take any corrective action herein, all necessary costs expended by the City will be assessed against the above described real estate and collected as other taxes; and be it FURTHER RESOLVED, that a certified copy of this resolution and incorporated Order herein be served upon the last record owners of the above described property in the manner provided by law. AMES, City Architect 445 City Hall, 55102 223-4212 May 17, 1972 Honorable Charles McCarty, Mayor and Members of the City Council Re: 1604 Mackubin File #2209 Gentlemen: The Bureau of Public Buildings is hereby submitting its report on the condition of the structure at the above location. The owners of record are Thomas J and Prosper DeLisle and the legal description of the property is the North part of Lot 2, Block 5 , Edwin M. Ware's Cumberland Addition Plat l. This is a two story single family frame dwelling 24 ' x 36 ' x 22 ' . The roof is burned and charred. The rear addition shows evidence of settling and the roof is leaking. The four rooms on the first floor are heavily damaged by fire. The partition between the kitchen and dining room is missing. The bath- room floor from the second floor is burned out and fallen into the kitchen. The second floor floor joists are burned out as well as the stair- way to the second floor making further inspection of the second floor impossible. The heating, electrical and plumbing systems are heavily damaged by fire. Members of the City Council May 17 , 1972 (2� Inasmuch as the conditions above constitute a public hazard, the building is so badly burned that it does not appear feasible that it be rehabilitated, the continued vacant and boarded up condition contributes a blighting influence on the neighborhood, and the owner has made no attempt .to satis�'actorily repair or remove the damage despite our warnings, it is �the recommendation of this bureau that this matter be referred to the City Attorney' s office for razing and removal through District Court proceedings.
