I am writing in response to the compliance check held at our store on July 17, 2002.
I understand the severity of selling cigarettes to minors and do not dispute the fact that
happened in the store on July 17"'. We have taken and continue to take numerous
precautions to prevent this from happening, such as:
• Snyders/Drug Emporiuxn participates in the WE CARE program, which provides
the employees with calendars and stickers to help them deternune the ages of ali
potential tobacco purchasers.
• All employees sign, and review with a manager, a copy of our tobacco policy at
the time of hire.
• After the second violation, we had all employees resign a copy of the same policy.
• Most recently we have had all employees sign the new hire "Customer Service
Guide", which again contains the policy.
• Numerous times we've written reminders on the bottom of employees schedules.
• There is a poster sized empioyee notice near the tune clock, warivug all
employees of the seriousness of the potential penalties involved with selling cigs
to minors.
In a11 four cases the employee asked for ID's but failed to properly check the birth date.
This is a traiuing issue that has been addressed in more detail. To show the employees
how serious Snyders/Drug Emporium is about compliance with this issue we have
terminated a 25-year employee for failing to follow company policy in regards to selling
tobacco to minors.
We would like for the City Council to reconsider the recommended revocation of Store
5010, Snyders/Drug Emporium Cigazette/Tobacco licenses.

Dear Sir/Madam:
The Office of License, Inspections and Environmental Protection (LIEP) has
recommended adverse action against the Cigarette/Tobacco License held by Snyder Drug Store,
Inc. d/b/a Snyder Dnxg Store, Inc. #5010 for the premises at 2083 Ford Parkway in Saint Paul.
The basis for the recommendation is as follows:
On July 17, 2002, a tobacco compliance check was conducted
at Snyder Drug Store, Inc. #5010 located at 2083 Ford
Parkway in Saint Paul. A ftfteen year old male entered the
store and asked to buy cigarettes. He was asked to show his
identification, and did so. It correctly stated his date of birth.
The clerk nevertheless sold him a package of Marlboro
cigarettes. 5ale of tobacco to an underage person is a violation
of Minn. Stat. §609.685 and Saint Paul Legislative Code
§324.07.
Since this is a fourth violation, the licensing office will recommend revocation of your
Cigarette/Tobacco license pursuant to Saint Paul Legislative Code §324.11 (b).
At this time you have three options on how to proceed:
If you do not dispute the above facts and do not wish to have a public hearing, you will
need to contact Ms. Christine Rozek, Deputy Director of LIEP to make arrangements for
the revocation of your Cigarette/Tobacco license. If this is your choice, Ms. Rozek can
be reached at 266-9090, or in writing at: Office of License, Inspections, and
Environmental Protection, Lowry Professional Building - Suite 300, 3�0 St. Peter Street,
Saint Paul, Minnesota 55102.

2. Altematively, if you do not dispute the above facts, but wish to have a public hearing
before the Saint Paul City Council to dispute the recommended penalty, you will need to
send me a letter with a statement admitting the violation and requestin� a public hearin�.
We will need to receive your letter by Friday, August 9, 2002. The matter will then be
scheduled before the City Council for a public hearing to determine what penalty, if any,
to impose. You will have an opportunity to appear before the Council and make a
statement on your own behalf.
If you do dispute the above facts, a hearing wiil be scheduled before an Administrative
Law Judge. At that hearing both you and the City will be able to appear and present
witnesses, evidence and cross-examine the other's witnesses. The St. Paul City Coupcil
will ultimately decide the case. If this is your choice, please advise my legal assistant,
Peter Pangborn, and we will take the necessary steps to schedule the administrative
hearing. He can be reached at 266-8710.
If we have not heard from you by Friday, August 9, 2002, we will assume that you
do not contest the facts and will schedule this matter for the St. Paul City Council and have
it placed on the Consent Agenda during which no public discussion is allowed and the
recommended penalty will be imposed.
Please be advised that the clerk who was identified as having made the sale on this date is
also being charged an administrative penalty pursuant to Minn. Stat. §461.12, subd. 3. This is a

scheduled for 5:30 p.m., Wednesday, August 28, 2002 in the City Council Chambers, Third
Floor, Saint Paul City Hall and Ramsey County Courthouse.

your Cigarette/Tobacco license.
