1 WHEREAS, the City of Saint Paul, on July 26, 2002, received a Notice of License
2 Revocation from the State of Minnesota stating that San Pelino, Inc. owes delinquent taxes to the
3 State of Minnesota; and

5 WHEREAS, San Pelino Inc., has Sunday On-Sale and Liquor On-Sale licenses for the
6 premises located at 1905 Stillwater Avenue in Saint Paul; and
8 WIIEREAS, Minn. Stat. §270.72, subd. l requires the revocation of any license far the
9 conduct of a profession, occupation, trade, or business held by an applicant who owes more than
10 $500.00 in delinquent taxes or has not filed returns; and

WHEREAS, under said statute the State of Minnesota must notify the applicant of the
intent to require revocation of such license, and of their right to a hearing; and
15 WHEREAS, a hearing under this statute is expressly provided to be in lieu of any other
16 hearings or other proceedings required by law, which would include the hearing provisions of
17 Saint Paul Legislative Code §310.05; and

WI3EREAS, the City has agreed with the Department of Revenue that the definition of
"revoke" as used in the statue is proceduraily the same as the process used by the City of Saint
Paul for a license suspension; and
WT3EREAS, the license suspension must be implemented within thirty (30) days of
receipt of the Notice of Taac Liability, and is in effect until the Commissioner issues a tas
clearance certificate; and
WHEREAS, no tax clearance certificate has been forwarded to the City of Saint Paul,
Office of LIEP, by either the applicant or the Commissioner of the Minnesota Department of
Revenue; now therefore, be it

2 RESOLVED, that the Liquor On-Sale and Sunday On-Sale licenses held by San Pelino,
3 Inc. d/b/a Pelino, located at 1905 Stillwater Avenue, be and hereby are suspended effective at
4 12:01 am. on August�, 2002, and will not be reinstated unril such time as the City of
5 Saint Paul has received a tax cleazance certificate from the Commissioner of the Minnesota
6 Department of Revenue, and has given written notice to the licensee of the lifting of said
7 suspension.
