WHEREAS, In the matter of Comptroller's ontract L-9007, City Project Nos.
70-G-1890 & 70-5-1401B, for the Improvement o� Streets, Alleqs and Sidewalks in
CENSUS TRACTS 9 & 10, CONTRACT B, and Constru�tion of a Stor�n Sewer System known
as Walsh-Ivy Extensions, Arcon Construction C�mpany, Inc., Contractor, the speci-
fied date of cos�pletion is July 15, 1971, andl
WHEREAS, Due to conditions beyond the Co$�tractor's control the Contractor
was unable to complete the contract by said d�te of completion, therefore be it
RESOLVED, That the proper City Officialslbe and they are hereby authorized
and directed to extend the time of completion�to November 19, 1971, provided that
the Contractor shall paq for all costs of eng neering and inspection performed
from November 1, 1971, through November 19, 1971, snd such costs shall be withheld
� �from the final estimate as provided for in the Special Provisions of the Contract,
and provided however, that this resolution shall have no force or effect unless
� the sureties on the Contractor's bond consent thereto and file such consent in
writing with the Citq Coanptroller, and be it ,
FURTHER RESOLVED, That the City of Saint Paul hereby makes no further claim
for liquidated damages or engineering and inspection costs on this project against
the Contractor for such eatended period.
