WHLREAS, In the matter of Comptroller's Contract L-9002, City Project No.
69-G-1889, for the Improvement of Streets, Alleys and Sidewalks in CENSUS TRACTS
9 & 10, CONTRACT A, Barton Contracting Canpany, Contractor, the specified date of
completion is July 15, 1971, and
WHEREAS, Due to conditions beyond the Contractor's control the Contractor was
unable to complete the contract by said date of completion, theref ore be it
RESOLVED, That the proper City Officials be and they are hereby authorized and
directed to extend the time of completion to November 19, 1971, provided that the
Contractor shall pay f or all costs of Engineering and Inspection perf ormed from
November 1, 1971, through November 19, 1971, and such costs shall be withheld from
the Final Estimate as provided for in the Specisl Pravisions of the Contract, and
provided however, that this resolution shall have no force or effect unless the
� � sureties on the Contractor's bond consent thereto �nd f ile such consent in writing
with the City Comptroller, and be it
FURTHER RESOLVED, That the City of Saint Paul hereby makes no further claim
f or liquidated damages or engineering and inspection costs on this project against
the Contractor f or such extended period.
