WHEREAS, The City Council, by resolution, C. F. 217625,
approved April 21, 1964, authorized acceptance of certain
described real property from Holiday Realty� Inc. , for the pur-
pose of constructing Shepard Road, .and in return therefor,
agreed to pay the sum of $4,000.00 as reimbursement to the owner
of the adjacent property for cost of constructing a five-foot
high cha.in link fence; and
WHEREAS� The City of Saint Paul ha.s not paid the sum of
$4,000.00 to the owner pursua.nt to the 1964 Agreement, and re-
quest has now been made for such payment; now, therefore, be it
RESOLVED, That upon receipt of a Release of All Claims in
form approved by the Corporation Counsel, executed on beha.lf of
the present owners of the pertinent real estate, the proper
City officers are hereby authorized to pay the sum of $4,000.00
to Holiday Realty, Inc. , and Watergate Marina., Inc. , said sum
to be paid from Public Improvement Revolving Fund 60Q0-745 to
be reimbursed from Fund 0920-461, (City Project No. P-0312 BR) .

the consideratio� of Four Thousand Dollars ($4,000.00) , to the
undersigned in hand paid, reeeipt wbereof is llereby acknowledged,
do hereby and for their suceessors and assigns release, acquit
. and forever discharge the City of Saint Paul, a munieipal eor-
poration of the State of Minnesota, of and from any and all c�aims,
actions, and causes of action whatsoever which the undersigned now
have or which may hereafter accrue on account of or in any way
growing out of the Agreement and Warranty Deed of Conveya�ce, dated
the 14th day of May, 1964, between Holiday Realty, inc. and the
City of Saint Paul, whereby Holiday Realty, Inc. conveyed to the
City a portion of Government Lot 4, Section 21, Township 28 �orth,
Range 23 West of th� Fourth Principal Meridian, aad Lot 1, Snelling
Out Lots, subject to certain conditions contained therein, the under-
�igned hsreby acknowledging that the sum��our Thousand Dollars
�$4,O�O.flO) received by them from the Citp as being full and complete
satisfaction and compliance with Condition No. 4 contained in said .
Warranty Deed (Document No. 1666847, Book 2006 RCR, Page 155, of the
Register of Deeds in and for Ramsey County, Minnesota) . It being
understood that the �ndersigned Holiday Realty, Inc. and its
successors or assigns do not waxve their rights under eonditions I.,
2, and 3 of said Warranty Deed.
