WI�REAS, The City of Sa.int Paul actin� through its Assistant Valuation
En�ineer has secured an agreement for the purchase of that certain easement
for sewer purposes described as follc�rs:
A perma.nent easement for the purpose of constructing and
maintaining public sewers on, under, across, and through
that part of Lot 123 of Hewitt's Outlots First Division,
lying northerly of a li.ne 5.0 Feet distant southerly of
and paralle7,, with the centerline of Wabash Avenue as platted
in Baker's Addition to the City of St Paul Ramsey Co Minn,
extended easterly across said Lot 123, except Wabash Avenue,
WI�REAS, The easement described therein is necessary f'or the Wabash
Storm Sewer System, and the price at which the easeanent may be purchased is
at the total amount of $�+75.00, a fair and reasonable price according to
the appraisal obtained by the Assistant City Valuation En�ineer; and
WI�REAS, The Assistant City Valuation Engineer ha.s recammnended the
purchase of said easement at the price stated above, as evidenced by his
report submitted herewith; now, therefore, be it

� � authorize the purchase of the above described easement, and be it

� � RESOLVED FURTHER, That the proper City ofPicials are hereby authorized
� and directed to pay to Hoerner Waldorf Corporation, record fee owner, the
��� < sum of $475.00, said sum to be paid to the aforesaid vendor f`rom PIR Fund
V o to be reimbursed Prom 1972 I,ocal Improvement Fund, Code 0920-1t�61, upon its
f�,irnishing evidence of �ood marketable title in the aforesaid vendor, and
the total payment to be made upon tender by said paxty of appropriate deeds
conveying title to said easement to the City of Saint Paul.

and Members of the City Council
Ladies and Gentlemen:
The Council of �he City of Saint Paul per Council File No. 258618, approved
June 2, 1972, a.dopted. Ordinance No. 15112 authorizing a.nd directing the acqui-
sition of certain easements necessary for the Wabash Storm Sewer System,
Project No. 5-1255A.
Pursuant to such authorization and direction, I, in m;y capacity of Assistant
Valuation Engineer, ha.ve secured an a�reement with the Hoerner Waldorf Corpo-
ration, owner of the land involved, for the purchase of an easement for sewer
purposes on their land for compensation in the amount of $�+75.00. Therefore,
it is reconunended to the Council that it authorize the purcha.se of this ease-
ment in lieu of condemnation at the price of $475.00 as negotiated with the
awner. '
The easement herein recomanended. to be acquired is more particularly described
. in the resolution submitted here�rith for your consideration and action.
The Council by its resolution, C. F. No. 258803, approved June l, 1972,
cancelled, annutled., and rescinded all orders in the matter of construction
of the said Wabash Storm Sewer System. Although the sewer project was so
terminated., the Department of Finance continued. processing the acquisition
of this pa.rticular easement for the purpose of establishing the ri�ht and in-
terest of the City in the easement area for a presently existing se�wer located
therein, a.nd to provide for possible ftzture se�rers.
