The C. I.B. Committee again ur.ges that a source other than C.I.B. bond fundc be used for funding sewer project. Sewer projects are so costly tliat the City is deprived of many desirable projects on which C,I.F, funds could be spent. Since the start of the program seven years ago almost half of the C.I.B. b ond funds have "gone down the drain" for se�,ler �aark. These projt�cts are no� visible i and raise questions as to �•�hat is happening to C.I.B. funds. ' . - ' _7_ ' - : � , i ' _ � FINA1vCING RECOMMENDATIdNS Tt�e reco�nendations as to finances are as follows: 1, $4,500,000.00 of general obligations bonds should be issued in 1973 pur- suant to Chapter 773 Laws of 1971. The proceeds of the bonds so issued should be expended on projects which have been priority rated by this I c.ommittee and which are listed under the general caption "Recommended 1973 Capital Improvement Budget." 2. '1'he $4,500,000.00 of bonds to be issued in 1973 should have a maturity of 10 years. 3. The present C.I.B. system of capital improvement prograuuning with the use of a priority rating system has worked we11 and the city should take steps to insure that it rema.in a permanent part of government in St. Paul. The Charter should be amended to contain provisions for permanent Long- Range Capital Improvement Financing with authorization for annual ex- , penditures of an adequate amount based on a formula related to the City's valuation rather than a fixed dollar amount. This Charter Amendment stiould be made effective before the Long-Range Capital Improvement Budget a legislative authority expites fn 1975. 4, C.I.B. projects funded by the City Council which have not had any action on them in a two-year period after such funding, should be pointed out by the Department of Finance to the C.I.B. Committee. This will enable the C.I.B. Committee to review the status of such projects and determine whether or not to recommend to the Mayor and City Council the advisability of continuing their funding. ���.�_--._..a 5. In addition to the annual status report required by Decetnber l of each year (City Ordinance 13679, Sec. 7), the C.I.B. Butler Members of the City Council Saint Paul, Minnesota Ladies and Gentlemen: In accordance with the provisions of charter section 10 . 03 (2) , I submit herewith the budget for the next fiscal year of the five-year long range capital improvement program. The charter provides that the mayor shall annually submit his recommended budgets to the council in accordance with a budget calendar to be established by ordinance. Such an ordinance has been adopted and in accordance with its provisions the Capital Improvement Budget was submitted to me as required. The city attorney has informed the Capital Improvement Budget Committee and me that the dates specified in the budget calendar and charter apply to the Capital Improvement Budget. After reviewing the Capital Improvement Budget, I returned it to the Budget Committee and requested a review of priorities , keeping in mind the urgent sewer backup problem on the East Side . This has been ineluded and I sincerely hope the revision compensates for the delay in the presentation of this budget. Please keep in mind in reviewing this budget that, while it must be adppted no later than October 25 in accordance with charter section 10. 06 , there is a procedure for revising the C. I.B. budget even after it has be�n adopted. This budget committee, my administra.tive assistant and I will endeavor to make ourselves available to assist you as you review this budget allocation. Chapter 773 of the laws of Minnesota 1971 continued the Capital Budget financing through the issuance of $4,500 ,000 of General Obligation Bonds for four (4) years - 1972 through 1975 . NotWithstanding any provision of the charter of the city of Saint Paul, the council of said city shall have power by a resolution adopted by five affirn►ative votes of all its members to , authorize the issuance and sale of general obligation bonds of the city in an amount of $4,500,000 for each calendar year for a four year period commencing with the year 1972, for the payment of which the full faith and credit of the city is irrevocably pledged. ' Section 2. The proceeds of all bonds issued pursuant to section 1 hereof shall be used exclusively for the acquisition, construction, and , repair of capital improvements. None of the proceeds of any bonds so issued shall be expended except upon projects which have been reviewed, and have received a priority rating, from a capital improvements committee consisting of at least seven members, of whom a majority shall not hold ' any paid office or position under the city of Saint Paul. The priorities and recommendations of such committee shall be purely advisory, and no buyer of any such bonds shall be required to see to the application of � the proceeds. Section 3. The council of said city shall by ordinance provide ' for the preparation and adoption, by resolution, of an annual capital budget for said city for each year of the aforementioned four year period, and no funds of said city, from whatever source derived, shall be expen<led for any capital improvement other than acquisition of office or mechanical ' equipment, or for minor remodeling or repairs of existing structures, except in accordance with said capital budget, which may, however, be from time to time amended as a council may by ordinance prescribe. Law 773, Sec. 1) Legal Definition of Ca ital Improvement - Capital improvement bond ' funds are restricted to use for acquisition, construction or repair of canital improvements, having a useful life in excess of three years. Such facilities are expected to have a useful life beyond the term of the bonds. (Ten years at present). F.quip- , ment which is a necessary part of a new facility to make it functional, generally is acceptable. When modernization of an existing facility suli- stantially increase$ its value, such modernization might be regarded as a , proper capital expenditure. Deferred maintenance expense ordinarily is not considered proper capital expenditure. Neither is expense for mobile eq�i.ip- ment, additional or replacement office equipment, short term oPerational ' equipment, upkeep or repair. Maturity of Bonds - Current CIB recommendation is that bonds terminate with- in ten years. The hope is that the city may some day get to a pay-as-you-�o � basis.
