i WHEREAS, on May 22, 2002, the City Council of the City of Saint Paul adopted Council File #02-452, said
z Resolution being the Ratification of Assessments for the Towing of Abandoned Vehicles from Private Property
s from August, 2001 through part of December, 2001 (File No. J0201 V, Assessment No. 0936), and
s WHEREAS, the property at 962 Burr Street, being described as:
Lot 14, Block 14, Fairview Addirion,
9 with the propezty identification number of 29-29-22-24-0166 was assessed an amount of $730.00 for the towing

iz WHEREAS, the I,egislative Hearing Officer recommends deleting the assessment because the property owner
�s states that said vehicle was towed from the public street, the Police Department is unable to show that the
�a vehicle was towed from private property, and the City cannot charge a property owner for towing vehicles from

THEREFORE BE IT RESOLVED, that the amount of the assessment for this property be deleted, and
BE IT F'[TRTHER RESOLVED, that the reduction of $730.00 be funded by the Exempt Assessment Fund.

It has been determined that the property at 962 Burr Street has been assessed for the removal of
an abandoned vehicle from private property, but said vehicle may have been towed from the
street instead, and should not have been assessed for said removal.

Regarding the assessment for 962 Burr Street, Nayfeh Wraidat, owner, File J0201 V:
This matter was ratified by the City Council on May 22, 20�2.
Gerry Strathman heard this matter at the July 2 Legisfative Hearing. The owner said that the
vehicle was towed from the street. John Betz said at the hearing that he would do some
further checking. Mr. Betz called later and said that the police departmenYs records do not
show where the vehicle was towed from.
Mr. Strathman recommends deleting the assessment for the following reasons:
1) the owner said that the vehicle was towed from the pub{ic street,
2) the City cannot charge a property owner for vehicles towed from a public street,
3) the Police Department is unable to show that the vehicle was towed form private property.
Please write a resolution for Council Member Reiter's consideration regarding Mr. Strathman's
recommendation on this assessment. I would write a resolution myself, but I know that your
o�ce would rather write it so that it is worded correctly.
