Kapsner to rezone from "B" Residence and Commercial to "C" Residence in order to maintain a 3-plex, on property located on the north side of East Lawson Avenue between Arkwright and Westminster Street. This property is further described as: Lot 29, Hendrickson's Addition. This matter was heard at the September 2, 1971 Board of Zoning public hearing. The staff report on file was sum�arized by noting the proposed use, the frontage and area, area zoning, the recommendation of the Comprehensive Plan, and the site and area conditions. The staff noted it is logical to have a "C" Residential district adjacent to a Con¢nercial district but this proposal is an isolated lot in a well developed section of the neighborhood. It was noted that the parking requirements would be difficult to meet since the house is not serviced by a public alley� and it covers most of the lot width. It was pointed out that the site is short of the area for a 3-plex in a "C" Residential district. Mr. Kapsner appeared on behalf of his petition stating that the house has been a 3-plex since 1940 and that he had a legal permit for it. He said there has never been a parking problem. As the Board discussed this matter, it was argued that this might set a precedence and there are many situations such as this one in the City. It was stated that the rezoning could be accomplished by means of a negative easement and that the property has been assessed on the basis of a 3-plex. A letter from neighbors supporting the rezoning was produced. A motion was heard to recommend approval of the rezoning on the condition that it be effective for the duration of the existence of the structure. HISTORY: None. C. PROPOSED USE: To continue the use of the existing structure as a 3-plex, D. FRONTAGE AND AREA: The property has a 40-foot frontage along East Lawson Street with a depth of 101.72 feet resulting in an area of 4,054.8 square feet. E. ARI:A ZONING: The frontage along the west 81de of Arkwright Street from Lawaon to Magnolia is zoned Coaanercial. The east side of Arkwright i.s zoned Co�ercial to north of Cook Avenue. The south side of Magnolia Avenue has three areas zoned "C" Residence. The rest of the area is "B" Residential. F. COMPREHENSIVE PLAN: The Comprehensive Plan recommends a medium density classi- fication for this area. G. SITE CONDITIONS: The site is occupied by a large residential structure.
