Dear Sir:
This is written in response to the appeal of Miss Cla ra LaBarre to
waiver Zoning Code Chapter 62.02 to allow a decorative wall along
the alley on property located between Summit and Grand on Lexington
Avenue. This property is further described as follows:
The south 47 feet of Lots 13 and 14, Block 39, Summit Park
Addition.
This matter was heard at the January 6, 1972, Board of Zoning public
hearing, at which time the staff report on file was suimnarized. A
letter from several neighbors to the subject property which supported
the variance was read. The staff noted that the subject fence separates
a residential use from a commercial use and commented that, under those
conditions, it may be advisable in general practice to allow such fences
subject to public review.
As the Board considered this matter, it was noted that the removal of
about eleven blocks of the wall would make it conform. Concern was also
expressed over the wa11's effect on pedestrian safety.
Subsequently, a motion was heard to reco�nend approval. The motion was
seconded and carried by a vote of 5 to 0.

I am the owner of the property at 28 South Lexington
Parkway, more particularly described as the south 47 ft. of Lot 13,
all of Lot 14, Block 39, Summit Park Addition in this city.
I am requesting a waive r of 5ection 62. 02 of the Zoning
Code which requires that a fence above the height of 3 ft. 6 inches shall
not obstruct vision to an extent in excess of 40 per cent. This is for
a decorative wall along the alley between Summit and Grand on Lexington
Avenue to screen my property from the parking lot and commercial
properties.

A. HISTORY: There is no zoning hietory for thia site.
B. PROPOSAL: The appellant seeka a variance to allow the retention of the existing
wall built along the alley.
C. NEED FOR APPEAL: Zoning Code Chept�� $2, Section .02, atipulates that a wall over
3'6" in haight which obatructa more th�tt 40'1', of viafon above that height shell be aub-
ject to setback restrictione. The appellant'8 wall extenda beyond the legal setback
line.
D. PRESENT STANDARDS: In an "A" R�aidence dietrict� the legal aetback ia 20% of the
depth of the lot unlesa modifi�d by the`eetback eatabliahed by other buildinga on the
block face.
E. SITE CONDITIONS: The eite is occupied by a single family residence fronting on
Lexington Parkway. A decorative concr�te block wall approximately six feet high is
along the alley line and extends from a point between the front property line and the
residence to the rear of the property.
F. AREA CONDITIONS: Adjoining to the nprth is a single family residence fronting on
Lexington Parkway. Acrosa the alley to the south is a filling station. Further east,
fronting on Grand Avenue, ia a bank snd a new enlarged drive-in facility and parking
lot. Grand Avenue frantage is deve�loped cammercielly.
