02-73Council File # 0.1. - � � ;-, � -, f ., : ; � � , ± ' ; S t =�., ` � ; '"' , �` ; ' � RESOLVTION CITY OF SAINT PAUL, MINNESOTA 6 Code §344.04(a)(6)b.; and 7 WHEREAS, the Licensee failed to respond to the Notice of Violarion or otherwise 9 10 11 12 13 14 15 16 17 contest the allegations; and WHEREAS, the Licensee previously admitted to a violation of Saint Paul Legislative Code § 344.04(a)(2) from August 31, 2001, for failing to accurately identify the customer who pawned merchandise, and a violarion of Saint Paul Legislative Code §344.04(a)(6)b. for failing to maintain a videotape from a September 7, 2001 transaction for the required period of time, which violations were the subject of a Notice of Violation dated October 24, 2001, but Licensee had not yet appeared befare the Council to argue the appropriate penalty; and 18 WHEREAS, the recommendation from the Office of License, Inspections and 19 Environmental Protection for the violations noted in the October 24, 2001 Notice of Violation 20 was a 10 day suspension of the licenses, said suspension stayed for a period of 18 months on the 21 condition that there be no further violations during that time and that the licensee pay a fine of 22 $2,OOO;and 33 23 24 WHEREAS, in light of the new violation the Office of License, Inspections and 25 Environmentai Protection has recommended that all the violations be considered together, and is 26 recommending that there be a combined penalty of a 30-day suspension of the licenses, with 27 fifteen of the suspension days being stayed for a period of 18 months on the condition that there 28 be no further violations during that tnne and that the licensee pay a fine of $2,000; now, therefore 29 be it 30 31 RESOLVED, that the Pawn Shop license held by Cash-N-Pawn of Minnesota, Ltd. d/b!a 32 Cash-N-Pawn, located at 490 University Avenue West in Saint Paul (License ID 55747) is 33 hereby suspended for a period of thirty days, with fifteen of those days to be stayed for a period 34 of 18 months on the conclition that: 1) there be no fuither violations during the 18 month period; 35 and 2) the licensee shall pay a fine of $2,000, said fine to be paid to the Office of License, 36 Inspections and Environxnental Protection within thirty days of the adoption of this resolution by 37 the Council and signature by the Mayor. The basis for the recommendation is as follows: Sgt. Simmons of the Saint Paul Police Department discovered in mid-December that a stolen Canon camera, seriai number 1042138 �vas pawned at Cash-n-Pawn, 490 University Avenue on October 15, 2001 at 11:51 (transaction number Q60882). The camera was stolen from a vehicle in Eagan and was reported to the police. Officer Simmons, upon learning of the pawn of the stolen item went to the premises of Cash-N-Pawn to retrieve the videotape of transactions from October 15, 2001. When he requested the tape, he was told by the manager that the video of that date could not be found. Sgt. Simmons advised him that he must try to find it and gave the manager four days to produce the video. On December 17, 20�1 the manager stated that he could not provide the tape from the transactions between 9:00 a.m. and 6:00 p.m., but was able to �nd a tape for transactions beginning at 6:00 p.m. on that date. Pursuant to Saint Paul Legislative Code §344.04(a)(6)(b) a pa�cnshop licensee must keep videotapes of ail transactions for a period of four months. The matter will then be scheduled for a hearin� before the St. Paul City Council to determine what penalty, if any, to impose. On the other hand, if you wish to dispute the above facts, I will schedule an evidentiary hearing before an Administrative Law Judge (AL3). If you wish to have such a hearing, please send me a letter stating that you are contesting the facts. You will then be sent a"Notice of . Sometime in mid-December l discovered that a stolen Canon camera serial # 1042138 was pawned at Cash- N- Pawn, 490 W. University, 651-227-5080. This was done on 10-15-01 at 11:51 hours and has transaction number 060882 assigned to it. This camera was stolen out of a vehicle in Eagan and reported on 10-15-01 under CN- Ol-OQ7816. St. Paul CN on this case is Ol- 265309. I went to Cash-N-Pawn to retrieve the videotape of this transaction in hopes of pursuing criminal charges against the pawner. Mgr. Jack Preston was unable to provide me with this videotape and didn't know if he could find it. I told him to try and find it, giving them four days to do so.The absence of the videotape jeopardizes this criminal case. On 12-17-01, Preston told me that he was unable to find the videotape. This is a violation of their operating regulations. Under Pawn Shop Regulations, chapter 344.04 (66), the licensee or Pawn Shop must keep videotapes of all transactions for four months. Preston is fully aware of this re�ulation and in fact, this store was in vioiation of the same regulation on 9-7-0 l. It should be noted that they did give me a videotape for 10-15-01 covering the hours startin� at 1800 hours or six p.m. They could not find the tape that covered their operatin� hours between 0900 and 1800 hours. St. Paul CN on this case is Ol- 265309. I went to Cash-N-Pawn to retrieve the videotape of this transaction in hopes of pursuing criminal charges against the pawner. Mgr. Jack Preston was unable to provide me with this videotape and didn't know if he could find it. I told him to try and find it, giving them four days to do so.The absence of the videotape jeopardizes this criminal case. On 12-17-01, Preston told me that he was unable to find the videotape. This is a violation of their operating regulations. Under Pawn Shop Regulations, chapter 344.04 (66), the licensee or Pawn Shop must keep videotapes of all transactions for four months. Preston is fully aware of this re�ulation and in fact, this store was in vioiation of the same regulation on 9-7-0 l. It should be noted that they did give me a videotape for 10-15-01 covering the hours startin� at 1800 hours or six p.m. They could not find the tape that covered their operatin� hours between 0900 and 1800 hours.
