WHEREAS, Chapter 293 of the Saint Paul Legislative Code was
enacted to regulate the subject of noise in the City of Saint
Paul; and
WHEREAS, §293.11 provides for the granting of variances from
the sound level limitations contained in �293.09, upon a finding
by the City Council that full compliance with Chapter 293 would
constitute an unreasonable hardship on an applicant, other
persons or on the community; and
WHEREAS, Rolling River Music and Film Festival, represented
by Mick Sterling, co-founder, who has been designated as the
responsible person on the application, has applied for a variance
to allow sound for film projection and live music at Mears Park,
on September 18 and September 21, 2002; and
WHEREAS, applicant is seeking a variance for the hours of
6:00 p.m. to 10:00 p.m. on September 18, 2002 and from 12:00 noon
to 6:00 p.m. on September 21, 2002; and
WHEREAS, if applicant is not granted a variance it will not
be able to present the event; and
WHEREAS, the Office of License, Inspections, and
Environmental Protection has reviewed the application and has
made recommendations regarding conditions for the variance; now,
therefore, be it
RESOLVED, that the Council of the City of Saint Paul hereby
grants a variance for September 18 and September 21, 2002 to
Rolling River Music and Film Festival, subject to the following
conditions:
1) The variance for sound for film projection
and live entertainment at Mears Park shall be
for the hours of 6:00 p.m. to 10:00 p.m. on
September 18, 2002 and from 12:00 noon to
6:00 p.m. on September 21, 2002.
2) Al1 electronically powered equipment used in
conjunction with the shall not exceed 95 dBA
as measured at 50 feet from the noise source.
