02-716ORIGI(�A.L Presented By Referred To Council File # � �. � � l (� Committee: Date .._ _,� WHEREAS, Chapter 293 of the Saint Paul Legislative Code was enacted to regulate the subject of noise in the City of Saint Paul; and WHEREAS, §293.11 provides for the granting of variances from the sound level limitations contained in §293.09, upon a finding by the City Council that fu11 compliance with Chapter 293 would constitute an unreasonable hardship on an applicant, other persons or on the community; and WHEREAS, Rolling River Music and Film Festival, represented by Mick Sterling, co-founder, who has been designated as the responsible person on the application, has applied for a variance to allow sound for live music at Harriet Island and Raspberry Island between September 18 and 22, 2002; and WHEREAS, applicant is seeking a variance for various hours on each of these dates; and WHEREAS, if applicant is not granted a variance it will not be able to present the event; and WHEREAS, the Office of License, Inspections, and Environmental Protection has reviewed the application and has made recommendations regarding conditions for the variance; now, therefore, be it RESOLVED, that the Council of the City of Saint Paul hereby grants a variance for September 18, 19, 20, 21 and 22, 2002 to Rolling River Music and Fi1m Festival, subject to the following conditions: 1) The variance for music at Raspberry Island shall be for the hours of 6:00 p.m. to 10:00 p.m.on September 18, 2002; from 6:00 p.m. to 10:00 p.m. on September 19, 2002; from 6:00 p.m. to 10:30 p.m. on September 20, 2002; from 6:00 p.m. to 10:30 p.m. on September 21, 2002; and from 7:00 p.m. to 10:00 p.m. on September 22, 2002. 2) The variance for music at Harriet Island shall be for the hours of 5:00 p.m. to 9:00 p.m. on September 19, 2002; from 3:00 p.m. to 10:30 p.m. on September 20, 2002; from 1:00 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 ��°r�� � _... .:. f�� 2002. to 10:30 p.m. on September 21, 2002; and 1:00 p.m. to 7:00 p.m. on September 22, d �' 1 " 3) All electronically powered equipment used in conjunction with the events at Raspberry Island and on the Great Stairs on Harriet Island shall not exceed 95 dBA as measured at 50 feet from the noise source. All electronically powered equipment used in conjunction with the events at HarrietIsland- Target Stage shall not exceed 100 dBA as measured at 100 feet from the noise source 5) The applicant shall provide personnel and equipment who shall provide continuous sound level monitoring for the times during which the variances have been granted on each of the dates to ensure compliance with Condition #3. 6) All electronically powered equipment, PA systems, loudspeakers or similar devices shall be turned off no later than 10:00 p.m. on September 18 and 19, 2002; 10:30 p.m. on September 20 and 21, 2002; and 10:00 p.m. on September 22, 2002 at Raspberrry Island and no later than 9:00 p.m. on September 19, 2002; 10:30 on September 20 and 21, 2002 and 7:00 p.m. on September 22, 2002.
