1 BE IT RESOLVED, that, upon the petition of Joseph Commers, as documented in Real Estate Division
2 File Number 15-2002, public properties hereinafter described are hereby vacated and discontinued as
public properiy.

5 The properiy to be vacated is described as follows:

7 that part of the alley in Block 1, Cromwell Place lying west of the northerly extension of the east
8 line of Lot 10, said Block 1

10 This vacation shall be subject to the terms and condition of Chapter 130, codified March l, 1981, of the
11 Saint Paul Legislative Code as amended, and to the following conditions:

13 l. That the petitioner's, their successors and assigns shall pay $500.00 as an administrative fee for
14 this vacation which is due and payable within 60 days of the effective date of this resolution.

16 2. That a permanent utility easement shall be retained on, over, under and across the vacated area on
17 behalf of the City of Saint Paul, Deparhnent of Public Works to reserve the right of the City to
18 maintain and operate any sewer in or upon said easement and to enter upon said easement or any
19 portion thereof at any time and from time to time, for the purposes of future construction,
20 reconstruction, inspecting, maintaining or repairing the same or any part thereo£ Said utility
21 easement shall be subject to the following conditions:

a. No buildings, structures, trees ar any temporary structure, material storage, fixture, or any
other objects that will prohibit normal access to utility facilities for maintenance purposes
will be permitted within the easement area.
b. Improvements in or upon the above described easement that do not prohibit the City from
exercising its reserved rights may be allowed by obta.ining written permission from the
Department of Public Works Sewer Division with the understanding that the restoration
and costs of such improvements shali be the sole responsibility of the petitioner, its
successors and assigns in the event the City exercises its reserved easement rights.

10 in any service pipe or connection in said reserved easement arising out of or resuiting
11 from any action or negligence of the petitioner, its employees, agents, or business
12 invitees.

15 Northern States Power Company, d.b.a. Xcel Energy.

City of Saint Paul, its officers and employees from all suits, actions ar claims of any character brought as
a result of injuries or damages received or sustained by any person, persons or property on account of
tlus vacation or petitioners' use of this property, including but not limited to, a claim brought because of
any act of omission, neglect, or misconduct of said petitioners or because of any claims or liability
arising from any violation of any law or regulation made in accordance with the law, whether by the
petitioners or any of their agents or employees.
S.That the petitioners, their successors and assigns shall, within 60 days of the effective date of this
resolution, file with the City Clerk an acceptance in writing of the conditions of this resolution and shall,
within the period(s) specified in the terms and conditions of this resolution, comply in a11 respects with

The City Clerk has refened to this office for recommendation the petiUon of Joe Commers for the
vacation of that part of tfie aIIey in BIock 1, Cromwell Place lying west of the northerly
extension of the east Iine of Lot 10, said Block 1.
This inquiry pertains to the vacation of City right-of-way only. The utility easements will be
retained. The petitioner will continue to use the vacated alley as a private drive.
Will you please advise me of any concerns you may have regazding this proposed vacation. I would
like to receive your comments before June 14, 2002 so I can prepaze a report to the City Council on
this matter. For your convenience, you will find a fax transmittal memo containiug a reply form on
the reverse side of this notice. If you would rather respond on your letterhead, please refer to the

I recommend a public hearing before the City Council be held on August 7, 2002 to consider a
pefition to vacate that part of the alley in Block 1, Cromwell place lying west of the northerly
extension of the east line of Lot 10, said Block l.
The purpose of the vacation is the vacated part of the alley will become a private drive.
This properiy is located in City Council District 4, Planning District 12.
The subject petition is in proper form and has been signed by the requisite number of property
owners.
