1 WHEREAS, the City of Saint Paul ("Cit}�') has determined that there is no longer a pubiic purpose for
2 owning a pazcel of surplus right of way purchased several years ago for the relocation and widening of
3 East Seventh Street between Sibley Street and Jackson Street; and

WHEREAS, the City wishes to vacate its interest in this property; and
6
7 WHEREAS, the City has received a request from the Department of Planning and Economic
8 Development ("PED") to convey the property to the Housing and Redevelopment Authority of the City
9 of Saint Paul, Minnesota ("HRA") for disposal to the adjacent property owner; and
10
11 WHEREAS, PED has determined that such conveyance will support public/private development efforts
12 currently underway in this vibrant area of downtown Saint Paul; now, therefore be it

RESOLVED, that, upon the petition of the City of Saint Paul, as documented in Technology and
Management Services Depaztment File Number 10-2001, the public property hereinafter described in
Attachment "A" is hereby vacated and discontinued as public property; and be it further
RESOLVED, that the Council of the City of Saint Paui hereby authorizes the proper City officials to
convey the vacated property by Quit Claim Deed to the HRA.
This vacation shall be subject to the terms and conditions of Chapter 130, codified March 1, 1981, of the
Saint Paul Legislative Code as amended, and to the following conditions:
1. That the HRA complete a survey of the subject property and submit said survey to the Public
Works Department and Real Estate Division;
2. That any expenses incurred, including the $500 administrative fee for this vacauon, shall be
paid by the HRA, its successars or assigns, that said expenses shall be due and payable within
60 days of the effective date of this resolution; and that the HRA shall reimburse the Ciry in
the amount of the gross proceeds from the sale of said property described.

All those parts of Lots 8 and 9 in Mayall's Subdivision of Block One of Whiiney and Smith's
Addition and of Block Seventeen of Robert and Randall's Addition to the City of Saint Paul,
according to the plat thereof of record, being more particulazly described as foilows:
Beginning at a point on the southeasterly line of said Lot 8, distant thereon 40.2 feet
southwesterly from the southwesterly line of Sibley Street, as laid out in said Mayall's
Subdivision; thence, along said southwesterly line, South 56 degrees 24 minutes 00
seconds West, assumed basis of bearings, a distance of 35.28 feet to the easterly corner of
the southwesterly 24.75 feet of said I,ot 9(otherwise known as the westerly 24.75 feet of
said lot 9); thence North 34 degrees 00 minutes 25 seconds West 5120 feet along the
northeasterly line of said southwesterly 24.75 feet; thence South 85 degrees 31 minutes
18 seconds East 2.37 feet to a point of curvature; thence along a curve, concave southerly
and having a radius of 98.64 feet and a central angle of 35 degrees 28 minutes 54
