PAUL couNCi� • OFFICE OF THE CITY CLERK FILE - � - CIL RESOLUTION—GENERAL FORM PRESENTED BY COMMISSIONE ATF RESOLVED, that the St. Paul Union Depot Company, be and is hereby granted a permit to construct a 685 car parking ramp on their property, which is located on the east side of Sibley Street between Fourth Street and Kellogg Boulevard; south of Kellogg Boulevard between Sibley Street and Broadway Street, more particularly described as follows: Lots 7 through 12 , Block 28, St. Paul proper; Lots 1 through 12 , Block 29 , St. Paul proper; Lots 1 through 6 , Block 3, Hopkins Addition; and all of Block 4, Hopkins Addition; all in accordance with the plans dated Received September 1, 1971; subjeet to the eonditions that the applicant furnish ventilation as required by the St. Pau1 Building Department, and that any exit problem that may exist shall be corrected to the satisfaetion of the St. Paul Building Department and subjeet to the condition that said applicant-permittee , and its su�cessors and assigns , shall make due compliance with all applicable provisions of munieipal ordinances, state statutes and rules and regulations of public authorities having cognizance. Marshall City Clerk Room 386 City Hall St. Paul, Minnesota 55102 Dear Sir: This is written in response to the appeal and application for a pern►it by St. Paul Union Depot Company to relax parking requirements and install'and operate a 685-car parking lot on property located on Kellogg Boulevard between Sibley and Wacouta Streets on the north and between Broadway and Sibley Streets on the south. This property �s fur'ther described by the 1ega1 description on file. This matter was heard at the January 20, 1972, Board of Zoning public hearing, at which time the staff summarized the staff report on file. The staff noted that some of the stalls and maneuvering areas are deficient according to standards established by the staff and that some stalls are short of the area according to standards defined by the Zoning Code, and these are being appealed. It was noted that most of the stalls in the area under the tracks met design standards while much of the problematic parking is under the Depot building. Changes requested by the Traffic Engineer were noted. A letter from the Building Department was read which presented the results of an inspection of the ventilation system. The letter, �uoted in the minutes) concluded that the existing system must be made . operable and additional exhaust ventilation be added to meet the requirements. A representative of the Union Depot Company said the facility is used mainly by people working for the railroad. He said they had no objections to the Traffic Engineer's suggestions and that starting the ventilation system would be no problem. As the Board considered this matter, they noted that the facility is presently used for contract parking. A discussion followed concerning the effect of the parking facility on the tax status of the Depot Co. Subsequently, the Board heard a motion to recommend denial of �oth the appeal and the permit on grounds that the parking spaces and ventilation system were inadequate and because the property should not be used for private enterprise until it is so taxed. The motion was seconded and carried by a vote of 5 to 0. At the February 3, 1972, Board of Zoning meeting, the Chair brought to the attention of the Board a letter from the Union Depot Company requesting that the permit appli- cation be reconsidered. The letter was not read to the Board but the Chairwoman said she understood that it presented the Depot Company's willingness to comply with all standards. The Board acted to suspend the rules concerning notification of surrounding property owners and to reconsider this matter at that meeting. k � � � N �' 'FIT ia�~s��-� � ��X O ` • y j` , � • � . Marshall • � Page 2 ' February 7, 1972 The staff noted that the applicanis could not make their parking stalls (as defined by the strue�ural pillars) conform to the depth requirements but could meet width requirements by putting only one car instead of two between the pillars. As the Board discussed this matter, it was noted that good, safe parking is needed in that area but that this facility is presently being used illegally since it has no permit. The inadequacy of the facility as it is presently operated was noted. Subsequently, the Board heard a motion to recommend approval on condition that the Union Depot Company redesigns the parking plans to the standards of the staff, to conform with City ordinances, and to provide sufficient ventilation. The motion was seconded and carried by a vote of 4 to 0. On February 4, 1972, the Zoning Board staff informed the Building Department about the action of the Board and the conditions concerning the ventilation standards. �n reference to the conditions concerning design standards, a letter from the staff wi11 be sent under separate cover.
