Dear Sir:
This is written in response to the Housing and Redevelopment Authority's
appeal to relax density, off-street parking requirements and parking lot
setback, and its permit to construct and maintain a 74-car parking lot
for a 220-unit low-rent housing project for the elderly, on property
located on the north and south sides of Jenks Street between Payne and
Edgerton. The legal description for this property is attached to this file.
This matter was considered by the Board of Zoning at its February 17, 1972
public hearing. The staff reports on file for both the appeal and the
permit were read as well as a letter from the Traffic and Accident section
of the Police Department.
Representatives of the applicant explained the proposal saying that the
building coverage of the site is only 10 percent. Parking will be pro-
vided on a ratio of 1 to 3 with plenty of open space which could be
converted to parking. They said that according to their experience, a
1 to 3 parking ratio is adequate for peak demand periods.
A representative of the Payne Avenue Businessmen' s Association appeared
stating his organization is asking that a larger area be provided on
the east part of the site as parking for retail customers.
Mr. Hart, attorney for the Housing Authority, noted they estimated the
business co�unity lost only fifteen on-street parking spaces by the
vacation of Jenks Street and said that the Authority could not be ex-
pected to provide off-street parking for Payne Avenue merchants.
As the Board discussed this matter, one member stated that the area
dedicated to the City for a turn-around area for the dead end of Jenks
Avenue could just as well be used for parking. Another member ex-
pressed recognition of the parking problem but stated that this pro-
perty should not be dedicated for public use.
After further discussion, the Board heard a motion to recommend approval
of both the appeal and the permit. The motion was seconded and carried
by a 5 to 0 vote.

A. IlIST01tY: Ttlis property was rezoned from "B" Residential to "C" Residential
on nugust 9, 1971.
B. AREA lONING: The frontage along Payne Avenue is zoned Commercial; the
adjoining areas north, south and west are zoned "B" Residence.
C. DF.SIGN STANDARDS: The plan meets design standards providing the required
parking area per car and with adequate maneuvering area. The parking area
and hi-rise have access from Edgerton Street by a horseshoe drive. The
driveway width at the property line scales 26' and tapers to twenty feet
for most of its length. The parking area abuts an alley along the north
property 1ine. Catch basins are located in the parking area and driveways
for drainage. Poured concrete curba and gutters define the parking area
��nd drivc�way.
D. FItON'TAGL AND ARLA: The irregular-shaped site has a frontage of 220.49
along the east side of Edgerton Stzeet with an area of 131,533 square feet.
The building has an area of 13, 100 square feet with a coverage of 9.96%
E. TRAFFIC ENGINEER: Reconunend 26' driveway at property Line. The plan is
not dimensioned in this area but scales 26' . The drive is to be designated
one-way as requested by the Engineer and used for city bus service.
F. SITE CONDITIONS: The site is developed with old residential structures, one
to four-family use; one 4-unit building on the north side of Jenks was
remodeled recently and is in good condition.
G. AREA CONDITIONS: The area is developed with old residential structures,
mostly one and two-family, in fair to poor condition. The average lot
si;e is about 5,000 feet.

Mr. Roaetter said he had just zeceieed the letter aad had on.lg s short time to study
it. He said he dida't believe a plan had been sent to Capt. Jyrka�. Cepte Jyrkas
mede reference to the closing of 3enks and Edgerton but Mr. 8osetter said he thiaks
anly Jenks Street !s being vacated.
Mr. Hart, representfng the HRA, said he would try to explain Capt. Jqrkas' report.
Only a portion of Jenke and none of Edgertore wculd be vacated, he eaid.
Mre �les Sorensoa� architect for the 'Hxll, pointed out that Jeaks 8treet will run nader
the denelopmem� as a pedestrian waik. Fie also noted that the Board had previoualy
approved the rezoniag for the development. The building itself will occupy 10'�G of the
site. �3ere will be a 2 to 3 ratio with plenCy of open area that canld be uaed for
additional p�rking.
Mr. Hart aaid the building occupies oaly 14� of the property aad Mr, Sorenson pofnted
out �6¢ open spuce oa the siCe pl.au.
Mro Aart pointed out that theq would rather hnve open apace remsin green than have it
bl.acktopped.
Mro McPartlin said thet none of the other HRA developments hene so many homes this close
to them. Mr. Hart replied thst many of them do and mentfoned several that are in the
middle of reaidential areas.
Mrs. Cochraae noted tha� there is sane movement against isolating older people in
spsrtments such as tht,s. She asked £f there wonld be adequate parking apace should
the develop�ment open up to fsmilies. Mr. Hart replied that these are aIl one-'bedroom
nnits and not the type reated by larger families. Mrs. Cochrane Chea pointed out that
in the future the buildings msy hsve to be �emodeled bec�use of the growiag oppoeition
to grouping elderly people together in these bnildings.
Mr. Hsrt eaid the elderlq are not �gainst this type of development. The Phalen
Community Council and Payne Aveau.e Basiaess men are represented here today in favor
of it. The ARA, has been before the Cocmcil and thia Zoning Board due to the rezouing
for the plsn. Othez than s Ietter from a lady Fiho is concerned about the rea�oval of
on•street parki'ng on Jeaka, there appears to be no opposition. The HxA has done a
survey in the area reg�rdi�g off-atreet parking and has fouad that, at the height of
demand, a one t� three ratia i� �dequate. Ae added that � number of homes in thia
area hed to be Acquired to provide � efte big eaough to handle this project. Same
20 units �rere zemoved which pr�riously used oa-street parkiag sp8ce.
Mr. Jfm Bergman, Payne Avemte Bnsiaegsm�►'s Associatiaa, stated ehey are asking thst
a larger area be provided for parking oa the esst side of the development because
Psyne Aveaue fs becomfag landlocked. He s�id the plan shows only a "turn around" oa
the east side with no parkiag spaces and they are very �ch coaceraed about losing
any more on-street parking apaces. He asked that more �xark�ng space be provided for
retail cnstomere.
Mr. Sart eaid thet according to an esti�ate. there would be a losa of fifCeen ou-etreet
parkiag spaces that might be uaed for business activitieg. Ae ssid he dida't thiek
the RRA could provide off-etreet parkiug spaces for Paqne Avenue mexchaate aad added
thst Mre Bergmun wss asking them to give off-street parking for private homeowners.

Mr. Bergmea said his organizatiou is in favor of the high-rise but they would lik.e
to hsve same parking provided here, at l�ast for two businesaea adjoinin8 oa the east.
Mro Sorenson said. aa he nadersCande the situatiaa, it is imposeible for the HRA to
dedfcate to th� Citq any more land than they have without grossly violatin,g the laad
area to density ratio. The design was carefully looked at With St, Paul traffic
plannere snd �hey advised HRA ehat there ahould aot be Farkiug in the JsQke turn-around.
Mr. Bergman said that twelve uwnthe ago, ss preaident of the association, he had made
e request that more parking space be provided and siace thaC time the srchitecte have
aot found an answer to the prablem. It appears that every effort has not been put
forth to solve this problem. He smid they had seen only one plan. However, if this
is the way it muat be to go thxough with the housing, they will no longer resi�t siuce
they are fn favox of the pro�ect.
Mra Aart auggested th$t if parkfag is a problem there, the ARA fs being asked to
mske an over-flow parking lot for the businesses.
Mre McPartlin said he was aot arguing about aay obligation an the part of H�tA to pre-
vide parking but he doesn't emderstan,d why tbe area on the east must be used oaly
for a traffic turn-around when it could be us�d for parking.
Mre Hart said the C�.ty Traffic Sngineer wanted it there beceuse the people driving
up Jeaks ma� not see that this is at dead-ead atreet and may need to turn arouad there.
This is a matter the Traffic Eagineer a�ust solve.
Mrs. Cochrane said she spmpathizea with the parking problem but she doeen't feel thie
property should be dedicated for public c�se.
Mr. Jim Goalet of the architect's office sAid that the parking needs of the business
dietrict should ag�in be presented �o [he appropriate Gitp offices for further consid-
er�tion.
Mr. Bergmaa comnented that there msy be ao parking along 3eaks in the fu�ure becauee
it conld become aothiag more th�n a service lane for thQ high-rise. Mr. Hert replied
that there would n.ot be that much sQrvice traffic in connection with a high-rise for
the elderly.
Mrs. Cochrane asked if anyone else had anything to add. Mr. Sasetter s�id t'hat the
plans presented to the Board by the applic�tnt today do not correspond with the plaus
submitt�d to the staff. Mro Soreason informed him that the plaa submitted to the staff
superseded his plan which he had displayed to the Bo�rd for inform�tion only.
In aaswer to Mrs. Cochrane'a er�xlies cryestion concerning the ma�cimum amount af park-
iag vhich could be provf.ded oa the site with the building, Mr. 8osetter said th�t he
Md Lsid ont s theoreticel scheme snd got a msxiun�n of about 250 cars.
Mr. Ames moved approval for the rela�cation of density and for approval of the parking

Dear Members of the City Council:
The Housing and Redevelopment Authority is completing plans for a hi-rise building
for the elderly which is to be constructed east of the intersection of Jenks Avenue
and Edgerton Street. The legal description of the property is shown on the attached
site plan drawing. The existing properties consist of duplex structures, single
family structures, and vacant land formerly occupied by the Ericsson School. These
properties are presently being acquired and demolished by the Authority. The pro-
posed use of the property is high density residential. The purpose of this appeal
is to eliminate unnecessary expenditures of public monies for excess land purchases
and parking lot improvements for this project for the low-income elderly.
In accordance with section 64.03.i. of the Legislative Zoning Code, the Authority
hereby requests a variance of the following sections of the code:
1. Density, Section 60.24.b. The Authority requests authorization to provide
not less than 590 sq. ft. of lot area per dwelling unit, as has been permitted
in the past for multi-story structures for low�income elderly. This density
figure is consistent with the proposed density for hi-rise residential construc-
tion as established by the Comprehensive P1an of the City of St. Paul. The
Authority proposes to construct 220 dwelling units on a land area of 131,533
square feet, which will result it� 597.9 sq. ft. of land area per dwelling unit.

With the hi-rise nature of the propose3�construction, the total lot area
covered by the building will be 13,000 sq. ft. , resulting in a site coverage
of only 10.0 percent. The Authority contends that this limited site coverage
resulting from the physical nature of hi-rise construction is one factor
warranting waiver of density limitations. It is felt that the existing zoning

Another factor relates to the number of persons to be housed on the site.
�,11 the dwelling units in the building, with the exception of the caretakers,
are one-bedroom units specifically designed for the elderly. The nucnber of persons
housed in the building will be considerably less than is normally encountered. In
other similar buildings operated by the Authority there is a ratio of 1.2 persons
per dwelling unit as compared with the City ,average of approximately 2.7 persons
per rental dwelling unit. The Authority feels that the density waiver requested
is reasonable, and consistent with the Comprehensive Plan of the City.
2. Off street parking, Section 60.23 (3), (a). The Authority requests a variance
from this section which requires 1'� off street parking spaces for each dwelling
unit.
The Authority has been providing at least one parking space for every three dwelling
units at eleven existing hi-rise buildings for the elderly. A recent survey in-
dicates tenant ownership of approximately 12 automobiles for each 100 apartments
for the elderly in our existing buildings. The Authority has found that peak
parking occurs in the afternoon on Sundays and Holidays and by providing one on-site
parking space for every three apartments, we are able to adequately accommodate
tenant's and visitor's automobiles. The Authority requests a variance of the
zoning code to permit the construction of one parking space for each three apartments.
An "Application for Special Council Use Permit", together with plans of the proposed
parking lot, are also submitted herewith for your approval.
3. Parkin� Lot set-back, Section 60.23 (5), (c). The Authority requests a variance
of this Section which states that parking facilities shall not extend closer to
a street than one half of the set-back required for a building. The building
set-back requirement is 10% of the depth of the lot in C resident districts.
The depth of this site is approximately 473 feet and extends from the east property
line of Edgerton Street to approxima.tely 120 feet west of the west property line
of Payne Avenue. The Authority requests that the set-back requirements be made
applicable to the single lot depth of approxima.tely 112 feet (this being the
dimension of the 2 properties fronting Edgerton Street in Block 16, Arlington
Hills Addition, adjacent to and south of the hi-rise site). This would result
in a parking lot set-back of approximately eleven feet, 3 inches which would
be consistent with normal set-back requirements.
Enclosed is our check in the amount of $72. This amount includes a $20 filing fee
for the zoning appeals and $52 for the parking lot permit fee.

A. HISTORY: This property was rezoned from "B" Residential to "C" Residential
on August 9, 1971.
B. PROPOSAL: 'I'he appellant proposes to develop the property with a high rfse
for the elderly with 220 dwelling units and a parking lot for 74 cars.
C. AMOUNT OF VARIANCE: 1) Density: the letter of appeal states that 220
dwelling units are planned for this "C" Residentially zoned site con-
taining 131,533. This area is 88,467 square feet short or 59.79% of
that required, so the variance is 40.21%. 2) Parkin� ratio: The plan calls
for 74 parking stalls. This is 256 stalls less than the 330 stalls required
under a 12 to 1 ratio. The percent of variance is 77.58%,
D. ESTA$LISH A NEW BUILDING LINE FOR THE PARKING LOT SET-BACK: The parking lot
setback is required under the Code to be 2 of that required for a building
which is 10% of. the lot depth in a "C" Residential district. The lot
dc�pth is 473.42 feet with frontage only on Edgerton Street. rormer Lots
on this parcel in the area where the parking lot is Located fronted on Jenks
Street rather than Edgerton. The appellant seeks to establish a building
line commensurate with the 112 foot deep lots fronting on Edgerton adjoining
this site on the soutti. This would be about eleven feet. The plans show the
parking 1ot setback 27 feet from Edgerton Street. Even if the setback
was computed on the basis of the 473.42-foot depth of the parcel, the
setback for the parking lot would only be 23.6 feet. Therefore, the staff
finds no need for an appeal reagrding parking lot setback at this time for
