WHEREAS, the City Council by its Resolution 256700,
approved December 15, 1971, approved the acquisition of
certain real estate for the expansion of Battle Creek Park,
subject to the owner providing good marketable title and
deed conveying title thereto to the City of Saint Paul; and
WHEREAS, the owner, Elna M. Metcalf, did convey by
Warranty Deed her interest to said property to the City of
Saint Paul for the above purpose and the Corporation Counsel
informs the City Council that the real estate taxes due and
payable for the year 1972 constitute an obligation of the
City inasmuch as the City acquired the interest to said real
estate after the levying of the said real estate taxes; now,
therefore, be it
RESOLVED, That the Council of the City of Saint Paul
does hereby authorize paym ent of the real estate taxes payable
in the year 1972 as it pertains to that property acquired by
the City pursuant to the above referenced resolution, said
taxes being in the amount of $395.30 and to be paid from
PIR Fund Code 6000-502 (L-7407) , to be reimbursed from Fund
9771-460-013

of the City of Saint Paul
Gentlsmen:
The City, pursuant to Council Resolution 256700, acquired
a portion of Lot 2 , Johnson' s Garden Lots , from the then owner
and the conveyance w�,s completed after January 1 � 1972 . The
present state law requires that the City, in acquiring property
for any public purpose either by eminsnt domain or direct pur-
chase, pay all real estate taxss lavied at th� time of such
acquisition, The real estate taxes pertaining to the abov�
land were levied prior to the time the City acquired title and
posssssion to the property and, therefore, it is my opinion
that the City of Saint Paul is obligated tQ pay the real estate
taxes in the amount of $395 . 30.
I have prepared a resolution approving this payment and hereby
request appr�val of the City Council .
