2 Division File Number ll-2002, public properties hereinafter described are hereby vacated and

6 convey tifle to all hereinafter described public properties by quit-claim deed to the Housing and
7 Redevelopment Authority of the City of Saint Paul, except for any part that will accrue to the adjoining

30 This vacation shall be subject to the terms and condition of Chapter 130, codified March l, 1981, of the
31 Saint Paul Legislative Code as amended, and to the following conditions:

33 1. That the petitioner's, their successors and assigns shall pay $500.00 as an administrative fee for
34 this vacation which is due and payable within 60 days of the effective date of this resolution.

36 2. That the petitioners, their successors and assigns agree to indemnify, defend and save harmless
37 the City of Saint Paul, its officers and employees from all suits, actions or claims of any chazacter
38 brought as a result of injuries ar damages received or sustained by any person, persons or
39 property on account of this vacation or petitioners' use of this property, including but not limited
40 to, a claim brought because of any act of omission, neglect, or misconduct of said petitioners or
41 because of any claims or liability arising from any violation of any law or regulation made in
42 accardance with the law, whether by the petitioners or any of their agents or employees.

1 3. That the petitioners, their successors and assigns shall, within 60 days of the effective date of this
2 resolution, file with the City Clerk an acceptance in writing of the conditions of this resolution
3 and shall, withiu the period(s) specified in the terms and conditions of this resolution, comply in

1 WHEREAS, Production of new housing is a top priority for the City of St. Paul and the City of Saint Paul has adopted
2 a strategic housing plan calling for 750 additional units of housing to be under construction in the year 2000; and
WHEREAS ,the Saint Clair(Qsceola site has been proposed as a development for more than 75 units of housing; and
WHEREAS, in the 1970's, the Saint Clair/Osceola site was the location for the deposit of soil excavated from the
construction of I-35E; and
6 WHEREAS, the State of Minnesota has indicated its wiliingness to allow removal of excess soil from the Saint Clair
7 Osceola site and its deposit along the right-of-way now used as landscaped buffer zone at the Southwest comer of the
8 intersection of I-35E and Saint Clair Avenue; and
9 WEIEREAS, the State of Minnesota Highway Department is willing to reconvey (turnback) Ramsey County Parcels 9
10 and 9A, I-35 at Saint Clair Avenue — Osceola Connection; and
11 WHEREAS, this site would be deve(opable except for the soil deposits and resulting topography; now, therefore, be it
12 RESOLVED, that the City of Saint Paul accepts the proposed tumback at any time, declares its support for the soil
13 relocation and states its continued intent to not request additional on- or off-ramps at this location; and be it
14 FURTHER RESOLVED, that this resolution be conveyed by Planning and Economic Development Department staff
IS to the State of Minnesota Deparcment of Transportation and urge expeditious action to relocate the excavated soil.

Dear Mr. Carison:
As you indicated in your correspondence dated 6i7i02, .vve have already responded to the
original vaca6on inquiry relative to the above-referencetJ matter. Please consider this our
response to the expanded version of the inquiry.
We still have the underground lighting feeder point ioc�ted somewhere along the north line
of the proposed area to be vacated for lighting on I-35E. Since the facility is underground,
absent a survey we cannot determine the exact locatior� so will reiterate ou� need to retain
the northerly 10 feet of the proposed vacafion area. We do not have affected facil'rties in the
expanded area.
Your Ietters regardtng this vacation have both noted tha't the purpose of the vacation is to
facilitate the development of the adjacent property to the south. Fo� the record, we do have
an electric transmission line to fhe south of the proposeii vacation area, but within the area
marked "pevelopmenY', with a formal easement. We re'ly upon your statement that all
easements will be retained.

MAYOR'S PETITION TO VACATE CiTY-OWNED LANDS
The City of Saint Paul hereby petitions to vacate the foliowing City owned lands:
Except that part lying within 33.00 feet of on either side of Line 1, described below, that part of Tract A
described below:
Tract A. The east half of Block 5, except the south 80 feet thereof, Stinson, Brown and Ramsey's Addition
to St. Paul, according to the plat thereof on file and of record in the office of the County Recorder
in and for Ramsey County, Minnesota, the title thereto being registered;
which lies northwesterly of a line run parallel with and distant 50 feet southeasterly of Line 1 described below
and southerly of Line 2 described below:
Line 1. Beginning at a point on the center line of St. Clair Avenue in St. Paul, distant 124.99 feet east of
the northwest corner of Section 12, Township 28 North, Range 23 West; thence southerly at an
angle of 89 degrees 37 minutes 42 seconds from said center line (measured from west to south)
for 100.44 feet; thence deflect to the right on a curve having a radius of 150 feet (delta angle 67
degrees 08 minutes 49 seconds) for 175.79 feet; thence on tangent to said curve for 533.86 feet
and there terminating;
Line 2. Commencing at the northwest comer of said Section 12; thence southerly on an assumed azimutt�
of 179 degrees 52 minutes 45 seconds along the west line thereof for 65.00 feet; thence easterly,
paraliel with the north line of said Section 12, for 100.00 feet to the point of beginning of Line 2

The State of Minnesota, having acquired it for trui�lc highway purposes, and having subsequently determined
that it is no longer needed, has conveyed the above described land to the City for the implied purposes of
deposition of excess soil from the development of housing on the property adjacent to the south. By vacating
this land and conveying it through the Housing and Redevelopment Authority to the developer of the adjacent
property, the City will be absolved of all liability and all responsibility for maintenance of the land.
The City of Saint Paul further petitions to vacate, except those parts lying within 33.00 feet on either side of the
above described Line 1, that part of Toronto Street and that pazt of the east half of Daly Street lying south of the
above described Line 2 and north of the foilowing described Line 3 and its northeasterly extension to the west
line of A. Vance Brown's Subdivision of Block 4 and the East half of Block 13, Brown, Stinson and
Ramsey's Addition to St. Paul:
Line 3. a line running parallel to and distant 50 feet southeasterly of the following described line:
Beginning at a point on the centerline of St. Clair Avenue in St. Paul, distant 124.99 feet easterly
of the Nor[hwest Corner of Section 12, Township 28 North, Range 23 West; thence run southerly
at an angle of 89 degrees 37 minutes 42 seconds with said centerline (when measured from west
to south) for 200 feet to the point of beginning of the line to be described; thence deflect to the
right at an angle of 67 degrees 08 minutes 49 seconds for 633.42 feet; thence deflect to the left on
a curve having a radius of 110 feet (delta angle 6'7 degrees 10 minutes 19 seconds) for 128.67
