The meeting was called to order at 10:02 am.

Robert C. Berg II, owner, appeazed and stated he called American Lung to see if he could give
the van to them. I1 still ran and did not look like a nuisance. He got a letter from a police officer
that his regisfration was not current. He called the officer back and left a message to get more
information from him. In the meantime, American Lung told him they would not take the
vehicle. Three weeks later, Mr. Berg got home from school, and the van was gone. He called the
police deparhnent, and they told him it was in the Impound Lot. He paid over $100 and signed
over the ownership to the City. His assessment is for about $450. He thought he was done with
the vehicle until he got a letter about today's meeting.
Maynard Vinge reported the poIice officer issued a summary abatement order on January 16,
2002. The vehicle was rechecked on January 28.
Mr. Strathman asked whp the City has $450 worth of starage fees if the owner signed the vehicle
over to the City. TJaat means it would have been on the lot for 1'/2 months. Steve Magner
respon�ed the police deparnnent has possession of the vehicle. T4iey should not be chazging
storage fees.
(Mr. Berg showed Mr. Strathman a receipt.)
Mr. Strathman stated Mr. Berg signed over tide on February 25, 2002. It was picked up on
February 20.
Mr. Berg stated he was told that he would just have to pay the service fee.
Mr. Strathman recommends deleting the assessment. There were five days storage fees plus the
tow and the service chazge. Mr. Berg paid $120, which is about the right amount.

Terrell Collins, owner, appeared and stated the vehicle that was towed had expired tabs. He put
the car in a pazking space in the back right next to the garage. The City towed it. He did not
receive a notice in the mail. Mr. Slrathman responded a notice was sent on December 19, 2002,
to remove the vehicle. He must have asked for an e�ctension because an eaKension was given
until January 8. Mr. Collins responded someone else in the house must have asked for an
eartension.
Maynard Vinge reported the inspector issued the orders on December 18. He gave an extension
to January 8, A work order was issued. The vehicle was picked up on February 6. It does not
indicate who requested the extension.
Mr. Collins stated the total of $500 seems a little high. Mr. Strathman responded the police are
charging $685 for storage fees. It must have sat there for more than two months, which is longer
than necessary. Mr. Magner concurred it should not have sat that long.
Gerry Strathman recommends reducing the assessment from $692.05 to $455 plus the $45
administrative fees for a total assessment of $500. He cannot find any problems with the
norification. Someone must have received the notice. The owner got a generous extension.
However, the chazge is higher than normal.
701 Jessamine Avenue East (J0203A)
Dominic Odumuyiwa, owner, appeared and stated he had some debris he had to remove, which
he did immediately. What the City took i� the back of his house was the sheetrock he was using
to do construction.
Mr. Strathman asked did he get rid of the refuse, gazbage, rubbish, household items, building
materials, and bmsh. Mr. Odumuyiwa responded yes, but the City took the sheetrock.
(A videotape was shown.)
Mr. Odumuyiwa stated the worker on the videotape said all is frozen. Mr. Odumuyiwa had a lot
of debris there, but that was wintertime. He removed all the bmken wood. Ttie sheetrock they
took was not the broken sheetrock. It was the sheetrock he was using upstairs.
Mr. Strattiman stated he saw a lot of trash, tires, brush. It looks like they left the sheetrock
behind that was there. Mr. Odumuyiwa responded the items on the floor with a plastic bag over
it is sheetrock and not debris. The one showing in the videotape, he could not get it out because
it was wintertime.
Mr. Strathman stated it should not have been there in the first place whether it was wintertime or
not. A person is not allowed to store debris and garbage in their yazd. If he thinks the City took
valuables, he can file a claim against the City for the value of those materials.

Anneal of vehicie abatement order for 1323 Bush Avenue
Michael Bartelmy, owner, appeazed and stated one vehicle was not licensed. He would like an
e�ension on all four vehicles. All the vehicles run.
Maynazd Vinge reported he has seen the vehicles. The owner is down to a tow truck and three
convertibles. The convertibles are ogen to access and susceptible to break ins. They have
akeady been damaged. There are current plates on one vehicle. One has a tazp over it, but that is
not securing the vehicle. It has been a long time since the City has allowed tarps over vehicle. If
the vehicles aze not maintained, they have to go. Mr. Bartelmy responded the truck is licensed.
The other vehicles have coliector plates.
Mr. Strathman asked what he intends to do. Mr. Bartelmy stated he is going to take one
conver#;ible up narth. His �treet is under construction, so one vehicle is going to be pazked in the
street. ?'he truck is �icensed.
Mr. Strathman stated he is not sure there is a real connec6on between finisiung the street and
storing the vehicles, but he will let the matter go. Mr. Vinge responded he does not have a
problem with an August 1 deadline.
Gerry Strathman recommends that the vehicles be brought until compliance by August 1, 2002.

Resolution ordering the owner to remove or repair the building at 860 Euclid Street. If the

Steve Magner reported this is a layover, it was originally here on Mazch 26. The previous owner
was Paul Voss, who entered into a purchase agreement with Dauid Casas. At that time, this was
laid over to give Mr. Casas time to secure the purchase of the properiy and start rehabilitation.
Currenfly, he has purchased the properry and is in the process of doing the rehabilitation. This
properry is a Category 2. The owner has made significant process and think he will be done in 60
days. Mr. Magner recommends laying this over for 90 days. If Mr. Casis obtains a code
compiiance certificate, Mr. Magner will notify Mr. Strathman.
Mr. Casas stated his mothea Sandra Casas purchased the property and he is representing her. He
received sign offs on the electrical and the plumbing. He is in the middle of his season as a
pavement mazking company and he is not able to spend as much time on the properry as he likes.
He plans to have it done in 60 to 90 days.
Bob Connor asked his plans for the house. Mr. Casas responded they aze not sure right now.
One scenario would be that they rent out the property; the second scenario, his mother may reside
in one of the units. It might be sold as well. The house has had some fire damage. His
philosophy is they would like it to be a house they would live in.
Mr. Connor asked his rental experience. Mr. Casas responded he has other properties in the City
that he rents.
Gerry Strathman laid over this matter to the October 8, 2002, Properry Code Enforcement
Meeting. The property will hopefully have a code compliance inspection by then.

The folIowing appeared: Peggy Franzwa, her son Josh, and her daughter.
Ms. Franzwa stated she had several notices to cleanup the properry. After she received the las�
notice, her father passed away on March 16. She asked could they clean it up later. It was
suppose to be her porch and her gazage on the notice, but the City went through the entire house,
boazded it up, condemned it, took her children, and took all her animals. She lost her job in
January 2001 and was on welfaze. She got a job again in August. Because of what this has done,
she lost another job. She has no money coming in and is currently unemployed.
Mr. Strathman stated he has two assessment here: one is in the amount of $295 for gazbage
hauling and a sumivary abatement for $2,020. Ms. Franzwa responiied she had a garbage service
m the backyazd. The City moved the gazbage to the front yard. The $2,020 is when the City

dismantled the garage. The City workers put her father's lawn mower and snowblower on the
side of the garage and someone took them.
Maynard Vinge stated he is short on the information for this address. He has a videotape, but he
does not have it here at the present time. As for the trash haulin�, she was given notice to get a
trash hauler. Ms. Franzwa responded she has one, and she catled about a month ago to give the
name of the trash hauler to the City. The trash has been removed.
Mr. Vinge asked was she no longer in the house because the house was condemned. Ms.
Franzwa responded she is in the house; it was uncondemned in a week. She does not want to see
the videotape because she knows it was bad. Her mother has Al2heimers. Ms. Franzwa works
full-time. Her ex-husband knew the problems in the house, but did nothing to fix them. No one
in the City would helg her with these problems. In addition, neighborhood broke the windows in
the gazage, and she has to fix them.
Mr. Strathman stated when there is a garbage or abatement situation, the City notifies the owner,
who is given the opportunity to make conecrions. If the situation is not corrected, the City does
the work. All the necessary conditions have been met to support this assessment. If the City did
some damage to her property, she may have a claim against the City. Ms. Frazizwa responded
that wiil not go anywhere. In all her dealings with the City, she has never gotten any satisfaction.
She is frustrated with the City, wan#s to move, but cannot because she lost her job.
Mr. Strathman stated he cannot reduce the assessment because he does not have any basis for
doing so under the law. Mr. Franzwa responded her ex-husband should get half of the bill. The
property is listed under Patrick Donnerbauer and Peggy Donnerbauer, but her last name is
Franzwa now. Mr. Sirathman explained the assessment goes against the properry.
Ms, Franzwa stated her fatd�er passed away. She called the (:ity and said she just got the
notification and asked could they postpone it for a week. They came over to the house without
Yhem being there. Her son came home. They would not present him with a seazch warrant. They
tore apart the house and tore apart the garage. They took her children and her pets. It would cost
her over $3,000 to get her animals back. She was told by Detective Morehead that she would
have her children back in a day, but she did not see them for a week. She cannot put her caz in
the gazage because the City nrined her garage doors
Her son stated there is damage to t3ie garage. The City opened both doors with a forklift and
neitiier garage door wili open. He got complaints about #he vehicle, which he was going to put in
the gazage but he cannot get the gazage door open. Someone scratched the van, dumped
something in the gas tank, and now his gas tank is not working properly.
The son asked is there a place that can help them. Mr. Vinge responded there is an organization
called House Calls. Ms. Frauzwa responded they helped get a dumpster to get some items out of
the house.

The soa asked can he file a claim against the police office who called them dirry pigs, worthless
scum, and said they did not deserve to live. Mr. Strathman responded they could contact The
Cluef of Police.
Roxanne Flink stated the cleanup cost could be spread over a ten yeaz period.

J02TR.AS 1 QA - spreading payment of the assessment over an eight yeaz period.
70202AAA - spreading payment of the assessment over a ten year period.
