Dear Sir: This is written in response to the petition of the Kay Realty Company for an amendment to rezone from "B" Residential to Commercial property located on the east side of Maria between Third and Conway Streets. This property is further described as follows: Easterly 20 feet of Lots 11 and 12, the Southeasterly corner of Lot 13 and the Southerly 25� feet of Lot 16, Block 38, Lyman Dayton's Addition. This matter was heard at the February 3, 1972 Board of Zoning public hearing at which time the staff report on file was su�¢narized. As the Board considered this matter, there was some discussion as to the exact property under consideration. The Board noted that part of it is now being used as a parking lot. SUFFICIENCY: In a letter dated January 12, 1972, the Commissioner of Finance declared the petition sufficient with the owners of 11 parcels or 73% of those eligible having signed the petition. I3. HISTORY: On October 22, 1949, a parking lot permit was granted for the original site (lots 13-16 of this block). In 1957 an appeal to allow a parking lot on the "13" Residential portion of lots 11 and 12, and a permit for that parking lot was considered but the appeal and application were withdrawn, C. PROPOSED USE: The petition declares the proposed use to be a parking lot. D. FRONTAGE AND AREA: The actual land under consideration has no frontage; it consists of t e rear 20' of 3 lots fronting on Maria Street for a total distance of 93 feet and the rear 25.25 feet of a 40 foot lot fronting on ' Third Street. The total area under consideration is 2,870 square feet. ' E. AREA ZONING: Maria and Third Street frontage is zoned Commercial. The area southwest of the Co�nercial district along Maria is "C" Residential. The rest of the area is "B" Residential, F. COMPREHLNSIVF. PLAN: The Comprehensive Plan calls for Commercial use of all four corners of Maria and Third Street with Third Street and Bates Street ` being collector streets. The Plan calls for the surrounding area to be in � high density residential use. G, SITE CONDITIONS: The subject property is level and in use as part of a parking lot used in conjunction with a supermarket. The property is a small portion at the rear of the parking area. � H.
