AND THE MINNESOTA STATE AGRICULTURAL SOCIETY TO USE THAT PART OF ALDINE STREET LYING BETWEEN THE SOUTHERLY LINE OF COMO AVENUE AND A LINE THAT IS 131.9 FEET SOUTHERLY AND PARALLEL TO SAID SOUTH LINE OF COMO AVENUE, FOR A NEEDED PARKING LOT BY SAID PERMITTEES. THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section l . That permission and authority are hereby granted to the < I��arnational Institute, inc. and the Minnesota State Agricultural Society to use that part of A)dine Street lying between the southerly line of Como Avenue and a line that is 131 .9 feet southerly and parallel to said South line of Como Avenue, for a needed parking lot by said permittees. Section 2. That the Conunissioner of Public Works is hereby authorized to issue a permit to the International Institute, Inc. and the Minnesota State Agricultural Society for using those said portions of Aldine Street upon and subject to the following conditions: , - � . a. That the said permittees shall , within thirty (30) days after the passage of this ordinance, file a written acceptance thereof with the City Clerk; d. That the permittees shall comply with all recormnendations of the City of Saint Paul in the construction of said parking area, and that the permittees shall be r�sponsible for obtaining all parking lot permits that may be required by the Saint Paul Legislative Code; e. Property damage insurance in an amount of not less than $50,000.00 for all damages to or destruction of property in any one accident. The coverage shall automatically be restored immediately after the occurrence of any accident or loss from which liabitity may thereafter accrue and the City of St. Paul shall be notified 10 days in advance of the cancellation of the insurance coverage by the issuing insurance company; j . That said permittee shall furnish a bond to the City of Saint Paul in the sum of five thousand dotlars ($5000.00) conditioned to comply with all the terms of this ordinance and to indemnify said City from all costs, and expenses that may accrue occasioned by the making of the improvement or arising out of the same; k. That said permittee shall submit bond and insurance documents to the Office Engineer of the Department of Public Works; 1 . That said permittee shall furnish the Department of Public Works all documents of record that are a part of the Contract or incidental to its execution including but not limited to addendums, "as built" plans and tracings; m. That said permittee shall , during the term of this permit, restore and repair all property, whether public or private, damaged or which may be damaged due to the construction, operation and maintenance or presence of the parking lot area provided for herein; n. The Council reserves the right to revoke this permit whenever in its opinion the public necessities or the public interest wilt be served by such revocation. Section 3. Hoyle Executive Director International Institute, Inc. � 1694 Como Avenue St. Paul, Mn. 55108 RE: �City of Saint Paul Ordinance No. 15069 Dear Mr. Hoyle: As you know, the City of Saint Paul Ordinance No. 15069 grants permission to the Interriational Institute to use that part of Aldine Street (unimproved) lying immediately adjacent to the property of the International Institute. Due to a mis- understanding as to the facts and because the St"ate Fair is technically the fee owner to one-half of that unimproved part . of Aldine Street, the City ,Council named the State Agricultural • Society as a co-petitioner .and co-permitee in the above-named . ordinance. As a result, they have asked the State Agricultural Society to accept and agree to all of the terms and conditions of this ordinance. I have reviewed this situation with Jerome Segal of the Saint Paul City Attorney' s staff. I advised him that the State Fair would not be in any way participating with the construction and improvements that the Institute intends to make on this parti- cular property and that the State Fair did not intend to in any way use this property after the improvements have been made. Based on our conversation, he advised me that it would not be necessary for the Minnesota State Agricultural Society to execute the accep- tance form submitted by the City. Accordingly, I am hereby suggesting that you have a proper official of the International Institute, Inc. execute the approval form and return it to the City Clerk along with this letter explain- ing why the State P�qricultural Society has not also executed the acceptance form. Mr. Segal further stated that if there were any problems, they should be referred to him for handling. That s�id permittees, after the inception of said improvement, shall prosecute the same continuously, with diligence, and fully complete said work to the satisfaction and approval nf said Commissioner on or before August 1 , 1972; g. That said permittees shall notify the Construction Engineer of the Department of Public 4Jorks when the construction starts and notify the � same said Construction Engineer whe� project has been completed to atlow for a final inspection; h. That said permittees shall not proceed with construction unless and until said permitteesshall have fully complied with the provisions regarding insurance and indemnification contained in the City of Saint Paul , Department of Pubtic Works Specifications for Street and Sewer Construction, dated April 1 , 1959, Section numbered 1 .44 of said specifications , as amended , applicable to contractors. For the purpose of this ordinance, the aforesaid section of said specifications , number 1 .44, as amended , shall be read as though the word "permittees"was substituted for the word "contractor", wherever the same appears in the aforesaid Section 1 .44, as amended ; said Section 1 .44, as amended, of the Specifications for Street and Sewer Construction in the City of Saint Paul is hereby incorporated herein by reference as fully and as completely as if set forth herein verbatim. Proof of compliance with provisions of the aforesaid sectio� shall be in such form as the Corporation Counsel of the City of Saint Paul may direct and the documents required by the aforesaid Section 1 .44 shall , after submission to the Corporation Counsel , be filed in the office of the Comptroller of the City of Saint Paul ; i . That seid permittees or successors in interest shall take out and maintain during the period af this permit and while the park�ng lot is located on said street a comprehensive p�otective public liability insurance that shall fully indemnify, hold harmiess, and defend the City af 5t. Paul , its ayents, officers and employess from any and all damages, claims� lnsses� judgments, suitS or expens�es on accaunt of all r:laims of whatever nature arisiny aut of or connected with the constructjon, maint�nance, operatian and remova� of the said parking lot. A certificate of this insurance shall be deposited with the City of St. Peul before the start af construction. The liability insurance shal ) be issued by an insurance compa�y licensed to da business in the state of Minnesota and the premium and all expenses inGidentai thereto shail be paid pranptly by the permitteesinitially and on renewal .
