This is written in response to the petition of Harold Rutchick to rezone
fram "B" Residence to Co�rnnercial for a parking Lot on property located
on the north side of Benson Avenue between Madison and Alton Streets,
further described as:
Lots 29-31 BLock 2, C. W. Youngman's Rearrangement of Block 2,
Palisade Addition
'ISzis matter was heard at the February 3, 1972 Board of Zoning public
hearing at which time the staff report on file was summarized. The
staff noted the proposed location of the office building as indicated
by the developer.
Mr. Anthony Danna, attorney for the petitioner, said this property, as well
as the adjoining property rezoned for this use in 1970, is still vacant.
He said construction of the office building would begin in early spring.
A resident of the area appeared stating he wanted more information. He
noted the petition made no mention of a negative easement to allow the
property to be used only for parking. He indicated it was unfortunate that
the petitioner did not purchase the residence on the corner adjoining the
proposed parking lot. He said residents of the area would like to stop the
industrialization of their neighborhood.
Mr. Danna said they are applying for a negative easement to use the proper-
ty only for parking.
Mr. John Swenson, another neighbor, expressed concern over how the water
from the parking lot would be drained and if surrounding property owners
would have to pay for the drainage.
The Board heard a motion to recommend approval of the rezoning with a nega-
tive easement for parking only which would revert to the present zoning when
the parking lot is no longer used. The motion was seconded and carried by
a vote of 5 to 0.
