Dear Sir:
This ;is written in response to the application of Emil 0. Tostenson
for a permit to install a used-car lot on property located on the
south�,test corner of Ross Avenue and Earl Street. This property is
further described as:
Lot 2, the south 50 ft. thereof, and all of Lot 1, Block 13,
Terry's Addition.
This matter was heard at the November 18, 1971, Board of Zoning
public hearing, at which time the portions of the staff report were
read as noted in the minutes. It mentioned that the Traffic Engineer
recommended approval of the plan and that the applicant had verbally
agreed to provide an eight-foot buffer along the western property
line.
The applicant explained his plans, stating he intends to do no mechani-
cal work on the cars at the new location. He confirmed that he will
provide the eight-foot buffer along the western property line.
Several persons appeared to express their concern over the proposal.
One person in opposition to the proposal presented a petition of 15
names representing neighbors opposing the use. The property owner ad-
joining the site to the west said she wanted a fence put up between
their properties. The plan with those changes agreed to now meet mini-
mum design standards without indication of such a screen fence.
As the Board discussed this matter, it was noted that there should not
be much traffic from a used-car lot. The motion for approval noted that
anything would be an improvement over the existing condition of the site.
The motion was seconded and carried by a vote of 5 to 0.

A. HISTORY: A permit was granted in 1943 to alter a driveway for an existing filling
station. There is no record of any previous zoning history for this site.
B. AREA ZONING: The frontage along this block face is zoned Commercial. The frontage
on rhe north side of Ross ie Comnercial and Light Industry. North of that area is
1.iKlit and 1{eavy Induetrial zoning. The north aide of the Seventh Street frontage
c�ast of F.arl ia zoned Light Induatry and the south eide is zoned Commercial . The
rest of the area south of Seventh Street is zoned "B" Reaidential.
C. DESIGN STANDARDS: The applicant has verbally agreed to eliminate the parking stall
adjacent to the north property line and to move the remaining stalls eastward far
enough to provide an eight-foot buffer between the lot and the residential use
adjoining it to the west. Driveways at the southeast corner of the site appear to
be superfluous and should be eliminated.
D. FRONTAGE AND AREA: The "L"-shaped property has a frontage of 127 feet along Earl
Street, 50.02 feet along Ross Avenue and 100.0�f+ feet along the alley for an area
of 8,853.54 sq. ft.
E. TEtAFFIC ENGINEERS REPORT: The Engineer approved the plan.
F. SITE CONDITIONS: The site is occupied with a small service station adjoining the
alley. Cars are parked on the vacant portion of the site.
G. AREA CONDITIONS: Adjoining the aite to the east is a small apartment. South across
the adjoining alley are one and two-family residences. North is vacant land used
for parking and the area to the east is developed with mixed residential uses .
