1 WHEREAS, The Saint Paul Division of Parks and Recreation holds a 3.2 beer and wine license for the
2 City's Harriet Isiand Park; and
WHEREAS, Section 19, Chapter 554, Minnesota Laws 1990 pursuant to Minnesota Statutes 1988,
Chapter 654.021 allows the Division of Parks and Recreation, with City Council approval, to sell wine and 3.2
beer at events sponsored by the Division of Parks and Recreation; and
6 WHEREAS, the City is entering into an agreement with Rose Presents Inc. thereby allowing their sub-
7 contractor, Game Inc. to be the exclusive vendor of beer and soft drinks at the following events scheduled to
8 be held at Harriet Island Park in 2002: We Fest Country Karaoke Championship on July 13, 2002 and Van
9 Warped Tour on July 28, 2002;
10 NOW THEREFORE BE IT RESOLVED, that the Game Inc. may use the Division of Parks and
11 Recreation licenses to sell 3.2 beer and/or wine at the We Fest Country Karaoke Championship and Van
12 Warped Tour under the following terms and conditions:

Sales shali occur onty between the hours of 12:00 p.m. and 10:00 p.m.
14 2. That prudent care will be taken to insure that all sales are made to persons age 21 and over
15 3. That proof of age for purposes of purchasing, possessing or consuming 3.2 malt will be
16 required by the issuing of non-removable wrist bracelets to individuals who have verified by
17 valid driver's license or identification card that they are the age of twenty-one (21) or over for
18 the Van Warped Tour event on July 28, 2002.

That prudent care will be taken to insure that no sales are made to individuals who are or
appear to be intoxicated.
That Game Inc. shall, at all times, comply with all State of Minnesota and City of Saint Paul
ordinances, laws, and statutes pertaining to the sale of 3.2 malt.
Alcohol Awareness training will be required for employees serving 3.2 malt at either event.

7. That Game Inc. shall provide {iquor fiability insurance in the amount of One Million Doflars
($1,000,000.00) for the dates of the events. A certificate of insurance naming the City of Saint
Paul as an additional insured shall be provided to the Division of Parks and Recreation prior to
any sale of 3.2 malt.

We Fest County Karaoke Championships is being held at Harriet Island on July 13, 2002 and Van's Warped Tour is
being held at Harriet Island on July 28, 2002. Game Inc. is providing vendor service for the events. In order to sell
beer and wine coolers Game Inc. needs to use the Division of Parks and Recreation's Beer and Wine Licenses for
Harriet Island Park.
