MINUTES OF �:zE MEETING ������ SAINT PAUL BOARD OF APPEALS Wednesday, February 9 , 1972 Room 210 , Bureau of Health, 555 Cedar St. 1:30 p.m. Members present: Donald Wozniak, Chairman Raymond Grove Estyr Peake Arthur Tieso Members absent: Mitchell Kamin Norma Sommerdorf James Voigt Agencies present: Building Department Frank Staffenson Bureau of Fire Prevention Dan Norrgran Others present: Thomas Anderson, James Klinkner, Margaret Grady, Robert Kelly, Rev. Kneely Williams . The minutes of the January 11, 1972 meeting were approved as mailed. h 2-72-H 932 East Third St. James Klinkner SUBJECT: Inspection report of January 5 , 1972 from the Building Department to James Klinkner, 438 Laurel Ave. , indicating poor water pressure in the cold water line of the second floor dwel- ling unit located at 932 East Third St. APPEARANCES : James Klinkn,er. PROCEEDINGS : Mr. Klinkner reported that all other code deficiencies but the defective cold water line have been repaired. He has dis- assembled the fixture but can find nothing wrong with it. If new piping is needed, it would mean tearing out the walls to get at it. He cannot financially afford such a major expense at this time. ACTION: Motion by Wozniak to waive the requirement that Mr.Klink- ner replace the tub faucet or replace the cold water line to - 1 - EXHIBIT "A" , ii'�:�...]1.111 y �`i U• l.� �� � increase the water pressure to the bathtub in the second floor dwelling unit at 932 East Third Street. Seconded by Grove� THE VOTE : Ayes : Wozniak , Grove, Peake, Tieso. Nayes : none. Abstentions : none. Motion carried four (4) to zero (0) . 5-72-H 251 Dayton Ave. Mrs . Margaret Grady SUBJECT: Letter dated October 29 , 1971 from Robert Ames , City Architect to Mrs . Ray Grady, 251 Dayton Avenue citing code vio- lations which must be corrected before a Certificate of Occupancy may be issued for the property. APPEARANCES : Mrs . Margaret Grady, Robert Kelly. PROCEEDINGS: All code deficiencies have been corrected except for providing bath facilities for each dwelling unit. This is what she is appealing. Presently there are 3-1/2 bathrooms in the building. There are 12 dwelling units with 13 tenants in total. There is one complete b athroom on each floor. None of the tenants h ave complained about the conditions . The modest rents �he charges is about all she can get in that area. ACTION : Motion by Tieso to waive Section 54. 11 of the St. Paul Legislative Code which requires that each dwelling unit have its own bath facilities . Said waiver is granted to permit 12 dwelling units to share 3-1/2 b athrooms . Waiver is granted until such time as the property is sold or any other right, title or interest is transferred at which time said waiver be nullified. Seconded by Peake. THE VOTE: Ayes : Wozniak, Grove , Peake, Tieso. Nayes : none. Abstentions : none. Motion carried four (4) to zero (0) . x 3-72-F 1115 Dayton Ave. , New Fiope Baptist Church b New Hope Baptist Church Rev. Kneely Williams SUBJECT : Letter dated January 7, 1972 from the Fire Prevention Bureau to Rev. Kneely Williams dis approving use of the b asement for a proposed day care center because it does not qualify for use by standards of the State Fire Marshal for other than auxiliary purposes . - 2 - i . . t�.l.t.,.J ♦ v .. � ,I APPEARANCES : Rev. Kneely Williams . P ROCEEDINGS : Rev. Williams explained that the proposed day care center is a joint effort of Independent School District #625 and Model Cities . The church would simply provide the space. The church is in an area where day care services are badly needed. It is proposed that approximately 29 children ages 3-5 be cared for there 5 days per week. Hours would be from about 7:00 a.m. to 5 :00 p.m. The basement consists of a large room and a kitchen. There are four exits from the basement. The boiler room is enclosed. It is proposed that food be brought in from outside and that it be only warmed up at the church. ACTION : Motion by [aozniak to waive the requirement that the church basement be used for auxiliary purposes only. Said waiver is granted to permit utilization of the church basement as a Day Care Cen�er and is granted on condition that a limit of 29 child- ren be cared for and that if the kitchen is to be used for other than warming of precooked foods (i .e. , if original cooking is to be done in the kitchen) that a hood, vent and automatic sprinkler be installed above the cooking facilities. Seconded b� Tieso. THE VOTE: Ayes : Wozniak, Grove, Peake, Tieso. Nayes : none. Abstentions : none. Motion carried four (4) to zero (0) . A discussion was had concerning a citizen's request to "grand- father" the Housing Code. A number of possible recommendations for change in the codes and procedures were discussed. Mr. Anderson was asked to provide a rough draft of these recom- mended changes to board members for discussion at the next regular meeting.
