WHEREAS, In the matter of Comptroller's Contract L-7372, City Project No.
71-5-1176B, for the construction of the FORD PARKWAY RELIEF SEWER SYSTF�I, Fischer
Sand & Aggregate, Inc., Contractor, the specified date of completion is September 17,
1971, and
WfiEREAS, due to unforseen difficulties and additional work the Contractor was
not able to complete the contract by said date of completion, therefore be it
RESOLVED, That the proper City Officials be and they are herebq authorized
and directed to egecute an amendment to said eontract extending the time of
cowpletion to October S, 1971, provided however, that this resolution shall have
� no force or effect unless the sureties on the Contractor's bond consent thereto
�� and file such consent in writing with the City Comptroller, and be it
FU RTHER RESOLVED, That the City of 5aint Paul hereby waives all claim for
liquidated damages and that no engineering and inspection costs on this project
will be char�ed to the Contractor for such extended period.
