RESOLVED, upon the pertinent appeal, under the Zoning
Code, by Robert and Janet Kuhlman, owners of the subject
premises, zoned in "A" Residence District, under the Zoning
Code, be and hereby are granted a permit to allow the
expansion of an existing motel by building a 14 unit addition
thereto, on property located on the south side of I-94 between
White Bear Avenue and Kennard Street, more particularly
described as follows:

subject to the condition that said appellants and their

Dear Sir:
This is written in response to the appeal of Robert and Janet
Kuhlman to a11ow the expansion of an existing motel in an "A"
Residential district on property located on the south side of
I-94 between White Bear Avenue and Kennard Street. This property
is further described by the legal description on file.
This matter was heard at the November 4, 1971, Board of Zoning
public hearing, at which time the staff noted that similar per-
mits had been previously granted. The staff questioned whether
a permit needs to be granted each time an expansion is made to
the motel once the original permit has been granted for a motel
in a residential district. The staff further questioned whether
the section under which this appeal is being made is still valid
under State Law since it allows by appeal a use not allowed in
that district.
Having viewed the site plan displayed by the appellant's attorney,
the Board heard a motion to recommend approval. The motion was
seconded and carried by a vote of 5 to 0.

A. HISTORY: An appeal for a permit to construct a six-unit motel was granted for
this site on June 7, 1955. An appeal to enlarge the existing motel was approved
on January 20, 1968 and again in 1970.
D. PROPOSAL: The propoeal ie to coastruct an addition to the exieting motel to
contain 14 more unite.
C. PRESENT STANDARD: Chapter 64� S�ction .03, Paragraph r permita the Council to
allow a motel adjacent to a trunk highway.
D. AREA ZONING: Adjoining to the eaat ie a large tract that is zoned Connnercial.
The rest of the area ia zoned "A" Residence. The Comprehensive Plan recommends
Commercial use of this property.
E. SITE CONDITIONS: The aite ia occupied by an exiating motel. The ground slopes
downward from the motel to the highway.
Fe AREA CONDITIONS: A large percantag• of the area is vacant and rolling land.
A single-family residence, a restaurant and motel is to the east. To the south
