WHEREAS, Davidson Company, Saint Paul, has indicated to the
Department of Public Works of the City of Saint Paul tha.t it is
desirous of installing or having installed a new electrically-heated
sidewalk in front of its property at 336 and 350 Robert Street; be
it
RESOLVED, Tha.t pursuant to the provisions of Sections 207 and
208 of the Saint Paul Legislative Code of the City of Saint Paul,
the Commissioner of Public Works is authorized to issue to said
Davidson Company or to a licensed and bonded sidewalk contractor
acting as agent for Davidson Company a permit to insta.11 a sidewalk
in front of the premises located at 336 and 350 Robert Street,
Saint Paul, Minnesota� and to incorporate in said sidewalk an
electrical heating unit for snow removal purposes; and be it
FURTHER RESOLVED! Tha.t such permit and the permi.ssion hereby
granted for such installation sha.11 be subject to the following
. conditions� provisions, and terms:
. 1. Tha.t said permi.ttee sha.11, at its own eost and expense
and in accordance with all applicable ordinar�.ces of the
City of Saint Paul and statutes of �h� S��a:�e o.f M��.e�smt� �}����k-
` construct, erect, ma.intain and operate said sidewalk in-
stallation.
� 2. That said sidewalk construction and installation shall
obe in conformance with plans heretofore submitted by said

suits and judgments on account of injury to person and/
or property arising from or connected with the construc-
tion, erection, maintena.nce, operation and/or removal
of said sidewalk and said electrical heating unit
installation.
4. Tha.t supplemental to all other obligations on its part,
said permittee and its successors and assigns sha.11 furnish
and ma.intain and pay all premiums and other expense for
public liability insurance coverage by an insurance company
duly licensed by the Commissioner of Insurance of the State
of Minnesota in an amount of $250,000 against liability for
injury to any one person and $500,000 for persona.l injuries
in any one accident, and against liability for injury to
property in an amount of $50,000 for any one accident, and
in the said amounts and for the said purposes respectively
indemnifying said permittee, its successors and assigns,
and the City of Saint Paul against liability on account of
all claims of third persons for injury to persons and/or
property arising from or connected with the construction,
erection, operation, ma.intenance and/or removal of said -
sidewalk and underlying electrical heating unit, and sha.11
furnish competent evidence of said coverage from time to
time to the Comptroller of the City of Saint Paul.
S. Tha.t said permittee shall within the period of 15 days
next after the effectiv� date of this resolution, file with
the City Clerk its written acceptance of the terms, pro-
visions� and conditions of this resolution and its agreement
to be bound by said terms, provisions and conditions thereof,
without limitation, which written instrument of acceptance
and agreement sha.11 be in form approved by the Corporation
Counsel.
