For the sole consideration of eleden thousand two hundred thirty seven
doilars and fif4y cerits ($17,237.50), the receipt and suffiiciency whefeof is hereby
acknowledged, the undersigned hereby releases and forever discharges the City of
Saint Paui, the Saint Paul Parks & Recrea4ion Department Paul Sims, their
empioyees, heirs, executars, administrators, agents, and assigns, and a!f other
persons, firms or corporations liable, or who might be liable, none of whom admit
any liability, from any and all property damage claims, demands, actions, causes of
action or suits of any kind or nature whatsoever, related to a 1996 Acuca SLX
which has resuited, or may develop in the future from an incident which occurred
on or a6out the 20`" day of May, 2002, at or near, the intersection of Saint Paul
L6venue and Davern, Saint Paul, MN.
The undersigned hereby declares that the terms of this settiement are fufly
understood and voluntarily accepted for the purpose of making a full and final
compromise adjusYment and settlement of any and all claims, disputed or
otherwise, on account of the property damage mentioned above. This release
covers any and all expenses including rental expense, tow charges, storage charges
and safvage bids.

havs signed the same, relying on my own judgment and on no representations of

On May 20, 2002, a vehicle driven by Paul Sims, of the Saint Paul Parks & Recreation Department, drove into the rear of Mr.
Pugach's parked vehide, pushing it into another vehicle. '
The claim will, be settled and the City's exposure will be capped.
