Marshall City Clerk Room 386 City Hall Dear Sir: This is written in response to Virgil Doerfler's appeal to relax the setback require- ments and application for a permit to install and operate a 207-car parking lot on property located on the south side of York between Birmingham and Hazelwood. This property is further described as follows: West 42 ft. of Lot 18, N. Z of Lots 19, 20, 21, Block 2, Cruickshank's Garden Lots and the N. 2 of Lot 22 except the N. 135 ft. thereof, Block 2, Cruickshank's Garden Lots. These matters were first heard at the January 6, 1972, Board of Zoning public hearing at which time the Board noted the matters were not represented. In response to questions from the Board, the staff said this involved a setback variance and the site had a variation in grade but not so large a variation that it could not be leveled. In discussing this matter, one member of the Board pointed out that the legal setback requirement is large because the lot is deep. Another member said this greater depth makes it easier to provide a greater setback. It was mentioned that 15 feet isn't a large enough setback and the appellant should have known the requirements at the time he purchased the property. Subsequently, it was moved that the Board recommend denial of the appeal because there is no hardship and that the application for a parking lot be laid over. These motions were seconded and carried. At the July 6, 1972, Board meeting it was disclosed that the appellant had sent a letter requesting the Board to reconsider the action of January 6, 1972. After some discussion, there was a motion to reconsider these matters at the next meeting. The motion was seconded and carried by a vote of 5 to 0. These matters were again heard at the July 20, 1972, Board of Zoning public hearing, at which time the staff report on file for the appeal was read. Concerning the permit, the staff noted that except for those items under appeal, the plan meets minimum design standards. The appellant stated he didn't know how he would get the buildings on the site without a variance. As the Board considered these matters, they discussed the setback of the houses at the corner of York and Birmingham. One member thought that the 1ega1 setback for the subject site was too great but that the requested setback was too small. � j �. G �•,, � � , Mr. Harry E. Marshall Page 2 August 2, 1972 Subsequently, the Board heard a motion to recommend approval of the setback variance because the adjoining houses are set back no more than 15 feet. The second motion expressed the belief that the development would be an improvement. This motion carried by a vote of 4 to 0.
