WHEREAS, the Cit of Saint Paul, as part of its Rice-
Arlington Athletic Field, condemned land in "Merrills Division
of Rice Street Villas" and received a deed from the owners
thereof conveying the property to the City of Saint Paul; and
WHEREAS, the HUD Guidelines require that the City insert
in all deeds conveying land to the City for open space projects,
a condition that the land may not be sold or otherwise transferred
without the prior written approval of the Secretary of Housing and
Urban Development, his designee, or any successor thereto, and this
statement was inadvertently omitted from the deed of conv�yance;
now, therefore, be it
RESOLVED, That the Mayor, City Clerk, and Acting Head of the
Department of Finance are authorized to execute on behalf of the
City of Saint Paul a declaration stating that this land so acquired
by the City for the Rice-Arlington Athletic Field and the City' s
interest therein is held subject to the restriction aforesnentioned,
and the City �ittorney is hereby authorized and -directed to file this
executed declaration in the Office of the Register of Deeds or
Registrar of Titles of Ramsey County.

Dear Mr. Lee:
Enclosed please find resolution authorizing the execution
of a declaration in connection with certain land acquired by
the City of Saint Paul for the Rice-Arlington Athletic Field,
an open-space program of the City. This declaration states '
that this land is subject to the restriction that the City' s
interest in the land cannot be sold or otherwise transferred
without the prior written approval of the Secretary of HUD.
This statement or declaration must be filed in the Office
of the Register of Deeds or Registrar of Titles and proof of
filing submitted to HUD as a condition for the City' s seeking
final rei.mbursement from AUD for this project. Please have the
City Council adopt this resolution, and our office will then
have the declaration signed.
