Ldilliam Donovan, Valuation Engineer Date: Augu.st 21, 1972 Subject: Improvement of the alley in Block 2, Birmingham`s 2nd Addition from Kennard Street to Fla,ndrau Street Fursuant to flzrther review and investigation of the subject proposed im- provement along with the Public Works Committee of the City Council and the Department o�' Public Works, this off`ice recoirunends: l. That the slope damages on this improvement be borne by the City of St. Paul to a maxi.mum amount of $3,000.00. S aid total amount to be pa,id from the Local Improvement Fund. 2. That a differential assessment rate be applied. The rate to the abutting properties on the north side be 50°� higher than the rate on the south side. The grading of this a11ey creates considerable datnage primarily to one property o�,mer where the house is seic back neaxly to the alleyline. This requires �he need for retaining walls and other slope protection to provide lateral support for the house in this area. The addition of the slope damages to the construction costs, in this instance, creates a very high a,ssessment rate. Also, the narrow �+0 foot lots on the north side of the a11ey do not provide adequate area for front drives or garages, whereas the proper- ties on the south, generally 60 feet or wider in width have adequate room and have provi.ded for drives and garages from the front. Should the City Council adopt the reco�nendations above the financing for this improvement and estimated assessment rates should be as follows: Tota1 Esti.mated Expenditures �11,675.00 Est. We think it both unfair and unjust to put us property owners through this expens•. We the people on the south si�le, aan not use the alley at all, this means we have excess to our garage's via the street. The contractor here is trying to get an alley in so he can build more homes on !�O ft lot's, had he not Ibean so greedy he could have built the homes on larger lot sites & had them come via street also. He wants us to pay for his construction, as far as we can see. z ��y �'� Most people on the street our on social secuity or widowed etc. Mr. Beach, having 3ust lost his wife through leukemia, has g surmountable cancer l�lls. We find out also that the alley was engineered without a sewer or cath basin� We already have water in our basements due to the dirt & fill left on grated. �his alley wou�d in no way improve our property or enhance it's beautification in anyway. It would be a burden to us moeny wise� and to no use to us what so ever. We were accessed last ye�r for a sewer in this area. I think the construction Company should pay for this alley if they think they ned� it. Mr Lentsch when purchasing property knew this also. Could we obtain a Lawyer to help our neighborhood or give us some legal advice. Thought we would inquire as to someome f roan the city. As you well know, we are all t,a.xpayers and also voter's and have a right to our convictions as well. May I make it very clear that all of uG that are living on York Avenue, do not need or will consent to this alley. Most of these homes have been built by con- tractors who took into account, the lay of the land and built accordin�;ly with garages that have access to the street. Now we have a contractor who is not or has not considered the need's of the people. He has not utilized the land properly, and I beleive he is �he one who should pay for this alley being he has proposed one. This Contractor has no interest in beauty or a safe area surrounding these homes. Proposing this alley is a sure way of promoti}�g unsafe place for our children and also making wav for theivery, as one would be able to park a car easily without one seeing it. I beleive that contractor's should not be allowed to come in and build homes and then let the rest of the people who have no need for an alley, pick up the tab and get awav with a nice little bundle, leaving other people with an expense they can neither afford or want. We were Accessed last year for a sewer, and now this year they want to access us for an alley, it is unfair and unjust, especially when we will not be usin� it or wanting it.
