I received today concerning a public hearing to be held on Friday�
July 28, at 10:00 A.M, to consider the transfer of an On Sa1.��Liquor
License from !�1lt Jackson Street to 87$ E. Thirtl Street.
I regret that previous commitments c�.11 prevent my attending
the hearing; however, a delegation representing our Community Council
will attend.
Please comrey to the c a�.ncil my continued opposition to the
transfer. It is my personal feeling that we have alre ady too many
bars in tY� area for its good. Also, I am conviriced that both the
members of my two congregations (Holman and Asbury United Methodist)
arxi the memb ers of our Community Council are strongly opposed to
having a tavern in the proposed loc ation.

On Ma.y 31, 1972, a letter was received by the License Inspector' s
Office of the City of Saint Paul from Henry Green who is the Vice-
President of Grace-Jackson, Inc. Grace-Jackson, Inc. , is the license
holder of an on-sale liquor license at 414 Jackson Street in the City
of Saint Paul. In the letter of Ma.y 31, 1972, Mr. Green requested a
transfer of the on-sale liquor license from 414 Jackson Street to
878 East Third Street and furthermore ma.de application for a change
in the officers of the corporation. Attached to the letter of Mr.
Green was a form application used in such matters by the City License
Inspector's Office. There did not appear to be a statement from the
bonding company pertaining to their approval of the cha.nge.
On June 1, 1972, the matter of the transfer came before the City
LicensE Committee and approval was given by the committee. The matter
was then forwarded on the same date to the entire City Council, and
at that time a motion was ma.de by Commissioner Meredith that the change
of officers in the application for transfer of the license to a dif-
ferent location be infortna.11y approved. Such motion was carried by a
5/0 vote (see attached minutes of Council meeting).
On June 6, 1972, several of the residents who live in the vicin-
ity of 878 East Third Street appeared before the Saint Paul City
Council to express their opposition to the transfer of the license
from 414 Jackson Street to 878 East Third Street. Following the pre-
�entation by the residents in opposition to the transfer, the City
Council requested a legal opinion from this office answering the
following question:

MORE, WHAT RAMIFICATIONS MAY RESULT IF THE CITY DECIDES TO

OPINION
The authority for and the required procedures pertaining to
the transfer of an intoxicating liquor license are found in Minnesota
State Statutes, State Regulations, the Saint Paul City Cha.rter (as
it existed on June 1, 1972, when informal approval was given), and
the Saint Paul Legislative Code.
By virtue of Minnesota Statutes, Section 340. 13, subdivision
9, a municipality may allow the transfer of a liquor license if the
Council approves such a transfer.
Approval by the City Council for a cha.nge in the location of
an on-sale liquor license is also required under Rule 36 of the
Regulations promulgated by the State Liquor Control Commissioner.
Rule 36, which also requires written consent by the bonding company,
provides as follows ;
"The location of business of a retail liquar licensee ma.y
be changed subject to the approval of the municipal council
and the commissioner in cases of 'off-sale' licenses.
Application for cha.nge in location sha.11 be in writing,
accompanied by a written statement from the bonding com-
pany consenting to the cha.nge in location."
Pursuant to Minnesota Statutes, Section 340. 11, subdivision 17,
which grants authority to municipalities to impose further restric-
tions and regulations upon the sale and possession of intoxicating
liquor, and Saint Paul Cha.rter, Section 127 B(3) (old Cha.rter) which
authorized the Council to regulate the sale of liquor by ordina.nces,
the Saint Paul City Council adopted Cha.pte� 308 of the Saint Paul
Legislative Code which regulates the sale and possession of liquor
licenses .
Saint Paul Legislative Code, Section 308.16, deals specifically
with transfer of intoxicating liquor licenses . The portion of Section
308. 16 which pertains to the present question before the Council
provides as follows :
"No license granted hereunder sha.11 be transferable from
person to person or from place to place without the con-
sent of the City Council which consent sha.11 be evidenced
by resolution passed by the City Council."

Since a resolution is required to transfer a license, it be-
comes necessary to follow the Cha.rter provisions dealing with the
proper ma.nner of passing resolutions. Under the old Saint Paul
City Cha.rter, which was in effect when the "informal approval" was
granted on June 1, 1972, a resolution was required to transfer the
license (Charter Section 116(c) and Code Section 308.16); a resolu-
tion must be presented to the Mayor for approval or rejection
(Charter Section 121); and the resolution must be published in full
in the official newspaper and recorded by the City Clerk before it
becomes operative (Cha.rter Section 123) . (It should be noted tha.t
under the present Cha.rter Sections 6.07 and 6.08, a resolution must
be in writing, must be presented to the Ma.yor for approval or rejec-
tion and must be published once in the official newspaper. )
It is quite clear that the Saint Paul City Council, in its
action of granting "informal approval" of the transfer on June 1,
1972, without a resolution as required by the Saint Paul City Cha.rter
and Legislative Code, did not legally transfer on-sale liquor license
No. 8177 from 414 Jackson Street to 878 East Third Street. Since a
legal transfer ha.s not taken place there is no need for action re-
scinding the prior "informal approval" since such prior action was
done without legal authority.
To make a valid transfer of the liquor license, the following
steps must be followed:
1. The applicant must make a written application;
2. The written application must be accompanied by a
written statement from the bonding company consenting
to the cha.nge in location;
3. A written resolution must be presented to the Council;
4. The resolution must be read unless such reading is
dispensed with by una.nimous consent;
5. If passed by a ma.jority vote, the resolution must be
presented to the Ma.yor for approval; and
6. The resolution must be published once in the official
newspaper.
While a public hearing is not required by law before the Council
votes on a transfer of a liquor license, it would be a suggested pro-
cedure to follow so as to prevent a court from holding that the
transfer was denied arbitrarily, capriciously and unreasona.bly. While

municipalities ha.ve a wide discretion as to the persons and places
to be licensed, "%� ; %� it is a fundamental intention of the law
tha.t in exercising this discretion it must exa.mine and investigate
the conditions within the municipality in an official capacity in
an effort fairly to determine the ma.tter from the standpoint of up-
holding the law and doing wha.t it believes best for the welfare of
the municipality, and not from a personal, arbitrary, or capricious

CONCLUSION
The City Council has never validly transferred intoxicating
liquor license No. 8177 from 414 Jackson Street to 878 East Third
Street. Therefore, there is no need to rescind the prior "informal
approval" since such prior action was done without legal authority.
The City Council must follow the procedures stated above in order to
validly transfer the license or the Council, after hearing sufficient
evidence, may refuse to approve the license transfer so long as such
refusal is not arbitrary, capricious, without foundation or unreasona.ble.

Mayor Cohen, Madam Chairman, Members of the Council:
I come to you on behalf of t he
people of Dayton�s Bluff, and particularly, in this case, of persons living within
a few blocks of the intersection of Mendota and East Third Stxeets. These persons
accoMpanyi:� me tYn s morning have come to make known to you ou.r opposition to the
location of a liquor store or tavern at that intersection, speci�ically in the
building formerly occupied by the establishment known as the "Tiger Tap.t'
Whereas on June 1, 1972, the St. Paul City Council informally approved the transfer
of a liquor license from 1�1.?�. Jackson Street to the corner of Mer�ota and East Third
Streets;
And whereas the citizens of the area were given no notice that such a transfer w as
pending, and had no opportunity to be heard by the council at that time, or to make
their desires known;
And whereas the neighborhood is predomiriantly residential in nature, and the resi�
dents strongly desire to keep it so; and whereas more busityess establishments�
especially of this type� w ould tend to depress residential pr�perty values in the
neighborhood;
And wh�reas the new Iocation for the license is approximately one-half block from
the Dayton's Bluff Playground, where large numbera of youth ai�d child ren congregate
each day and evenin�;
And whereas the said lo�ation is approximately one and orbe-half blocks from the
Van Buren public school, and three very short blocks from the Sacred Heart parochial
school, and numbers of children necessarily pass the spot several times daily;
And whe reas there are aiready four taverns on East Third Street between Maria Avenue
and Forest Street, a distance of less than five blocks, these being "The Gl.ass Bar"
at 299 Maria, Bolandts Liquor and Foods, 685 East Third Street, Lars' Pub, 804 East
Third Street� and ''The Bee Hi.ve", 937 East Third Street, and two of these are little
more than a block on either side of the proposed location;
And whereas there is no off-street parking available to customers of t his busir�ss,
should it be establi�hed as pro posed {and there is no parking at ar�y t:mQ on the
north side of Eaat Third Streot in this block);
And whereas anot,her tavern in the area could provide impetus for a number of
additional social problems;
And wheras the "Tiaer Tap« which hacl previously been located on this corner was
f_ound to be extromsly ob�ectionable by the resident.s of the r�earby homes, even
though it had cnly a 3b2� beer license;
I therefore prPsent t�o you, on �ehalf o.f the residents af Dayton�s Bluff, our
petition that �he City CcT.xncil of St. Paul take action at once to rescind its
inform�l approfrai of the transier of th.is l.iquor license from 1�1.lt Jackson Street to
the corner of �as+ Tr.as d �nd Mendota Street,s; and that the Council set a policy of
not grantir.g licneses� land use perm3.ts, or rezoning without first consul�ing the
residents of the Ioc�l com�vnity affected by such action, This petition is sigr�d

Whereas on June lst, the St. Paul City Council "informally" approved
the transfer of a liquor license from 141l� Jackson to the corner
of Nlendota and E. 3rd str�et.
Whereas the citizens of the East 3rd St. area were ga.ven no warninS
of such change nor the hearings necessary for it.
Tahereas the neighborhood is predominantly residential, and is fighting
very hard not to beccme a commercial area.
Whereas the new location of the bar is only � block from a playg�nd
and l� blocks from a school.
Whereas another tavern in �he area (there are already four within a
six block radi.us of the proposed location) could provide impetus
for a number of social problems.
Whereas there is no off-street parking, available to consumers of this
business.
T�hereas more business establishments, especially of this type, would
lower residential property values in the neighborhood.
Whereas the Tiger Tap which had prev.i.ously been located on this corner
was found objectionable by the residents even though it had only
a 3-2 license.
