Nelson, Inspector, Office of License, Inspections and Environmental Protection. The meeting was called to order at 9:15 a.m. 1546 Case Avenue Gerry Strathman, Legislative Hearing Officer, stated the purpose of this hearing is to consider an appeal requesting a fence height variance for the property at 1546 Case Street. Lori Page, owner and appellant, was present. Lori Page stated she is requesting an eight foot high fence to be installed at her residence due to her son's disability and his inability to communicate with others. Their home is located in a high traffic area on Hazelwood and Case Streets, where people drive through stop signs and drag racing occurs; also, there are railroad tracks that are located one block away. The installation of this fence will assist in her child's safety. Ms. Page submitted documentation from Saint Paul Public Schools, her son's doctor and Professor of Pediatric Neurology at the University of Minnesota and also from her next door neighbor, which describe's her son's behavior and justifies why an eight foot fence is necessary. Gerry Strathman said he has difficulty understanding how a seven-year old child can climb over a 6'/z foot fence. Ms. Page clarified that he can either push items to the fence or stack items so he can climb over it. In consultation with the school district and Ramsey County, it was agreed upon that an eight foot fence was necessary and the county assisted her with the funding for it. Mr. Stratlunan inquired why Ms. Page wished to install a privacy styled fence versus a chain link styled fence. Ms. Page responded that her son would be able to climb a chain link fence very easily whether it was 6'h or 8 feet high. The reason for installing a wooden fence is so he doesn't have the ability to climb over it and get out of their yard. Dave Nelson, inspector, from the Office of License, Inspections and Environmental Protection stated when a fence variance is requested, it is generally a terrain issue. However, this variance is totally a different situation and doesn't meet their criteria for granting a variance, so that is why it was referred to the Legislative Hearing Officer. He indicated that Ms. Page will have to install the fence so there are no horizontal rails and the smooth boards would have to be installed on the inside of the yard, so it would be more difficult for the child to pull himself over the fence. Mr. Nelson said their office raises no objections to this variance. Mr. Nelson responded to Mr. Strathman's question whether he considers an eight foot privacy c�z �s� Properiy Code Enforcement Meeting Notes - June 14, 2002 Page 2 fence to be a major visual barrier for the neighbors. He indicated that the fence would be visible on the Hazelwood Street side, however, it would be visually less on the east side where there is a hill and on the back side where there aze many trees. Gerry Strathman's recommendation is to grant a variance for an eight foot high privacy fence for the side and reaz of the property. His decision was based upon the sufficient record created with the recommendarions from Ms. Page's pediatric physician and Ramsey County who aze knowledgeable in this azea. Also, Mr. Strathman doesn't believe the installation of this fence would cause sufficient hann to the neighborhood. The meeting adjourned at 9:26 p.m. nla
