Marshall City Clerk 386 City Hall St. Paul, Minnesota 55102 Dear Sir: This is written in response to the appeal of New Jerusalem Baptist Church to relax the 25-foot distance requirement for Residential property and relax the 30% maximum lot coverage and relax the setback, on property located on the north- west corner of Carroll and Fisk. This property is further described as: Lot 18, B1ock 5, E. Dean's 2nd Addition, except the south 67 feet thereof. This matter was considered at the June 15, 1972, Board of Zoning public hearing. The staff report was sutmnarized. The staff clarified the building coverage and distance-to-residential-use requirements noting that an obscure section of the Code allows institutional uses in residential districts only when adjoining in certain ways other non-residential uses or if their structures maintain a 25-foot distance from residential property and do not exceed 30% building coverage. This site does not conform to any of those conditions. The remaining variance request is for the usual front yard setback. The staff said they had received calls from residents of the block who feared that the proposal would cut off access to ti�eir garages. The staff said that there is no alley platted in this block but that these residents apparently have relied on access across private property for some time. The staff said the Corporation Counsel thought there may be a legal case in this situation but that it would be a matter between private parties which need not involve the City. The appellant's architect spoke on behalf of the appeal. He stated they had met with those residents concerned"about the access andmaintained there would be no obstruction of the alley. Several persons appeared saying they had been concerned about the access but would pose no opposition if the access is not obstructed. The Board examined the plans and snapshots of the site in an attempt to determine the location of the proposed expansion in relation to the so-called alley. Sub- sequently, they heard a motion to recommend approval provided the Church does not block the alley. The motion was seconded and carried by a vote of 4 to 0.
