Marshall City Clerk 386 city hall St. Paul, Minnesota 55102 Dear Sir: This is written in response to the application of Northwestern Bell Telephone for a permit to install a 48-car parking lot, and their appeal to permit the use of "C" Residential property for a Public Utility facility, on property located on the northeast corner of Fairview and Shields. This property is further described as: Lots 56, 57, 58 of Block 11, Howard Park. These matters were heard at the June 1, 1972, Board of Zoning Public Hearing at which time the staff noted that in a similar matter, the Zoning Administrator's office had judged that the Corporation Counsel's opinion of March 6, 1968, which held that certain appeal sections of the Zoning Code dealing with extensions of use were invalid, did not apply to the paragraph under which this appeal is made. The history of zoning actions on this site was given. Concerning the parking permit, the staff said correspondence received from the Highway Department suggested a different access than that proposed by the Traffic Engineer. When this was brought to the attention of the Traffic Engineer, he studied it again but did not change his recommendation. The staff also noted that revised plans neglected to include some of the changes requested. A representative of Northwestern Bell said they could provide all the changes requested. Several neighboring residents appeared and asked questions about the proposal. A motion to recommend approval of both the appeal and permit subject to the requested changes was made and seconded. STAFF INVESTIGATION & REPORT: Date: May 25, 1972 By� ATB A, ZONING ADMINISTRATOR: On March 4, 1971, in a similar matter the zoning administrator judged that the legal opinion of March 6, 1968 which held invalid certain appeal sections of the legislative Zoning Code which provide for extensions of use did not invalidate Section 64.03 (g), which grants the City Council power to allow by appeal a public utilities building in any district. B. HISTORY: An appeal to construct an addition to the existing Telephone Exchange building on Lots 59, 60 and 61 was granted on May 6, 1954. On March 13, 1958, an appeal was granted to consYruct aa addition to the building on the site enl3rged to include Lots 62 and 63. On June 23, 1959, a permit was granted to construct a 16- car parking lot on this property. C, PROPOSAL: The three lots described in this appeal are to be developed as a 48-car employee parking lot. D. NEED FOR APPEAL: An addition is proposed for the Telephone Exchange which would eliminate an existing empioyee parking lot. ' F. PRESENT STANDARD: Public utility buildings are not automaticaily authorized in Residential districts. F. AREF ZONING: The area adjoining to the north is zoned Commercial and the frontage along University Avenue is zoned Light Industry. The rest of the area is zoned "C" Residence. G. SITE CONDITIONS: Three oider homes occupy the property. The site appears level heing about three feet above the grade of Fairview Avenue and at grade along the � alley line. It is about two-three feet higner than the lot adjoining to the north, H, AREA CONDITIONS: Fairview Avenue is heavily traveled in this area. It swings slightly to the east to go under the freeway and railroad to the south. The area is developed with mixed Residential uses. The residences fronting on Beacon Street use the adjoining narrow alley for access to their parking area. , 9.
