F. Eisenmengers Addition to Saint Paul, according to the plat on file and of record in the office of the Register of Deeds in and for the County of Ramsey, State of Minnesota. WHEREAS, pursuant to resolution, C. F. No. 255953, approved October 5, 1971, a public hearing was duly held on October 14, 1971, before the Council of the City of Saint Paul, said hearing pertaining to the condition of the structures located at 1058 Rice Street, - . Saint Paul-,, l�IinnESOta; and r. . - . . . � � . � WEIEREAS, upon the facts presented s� the said hearing consisting of photographs, inspection; reports and the recommenda- tions of the Building Department, it is found and determined by the City Council that according to the records and fil�es in the office of the Register of Deeds, the last record owners of the above described property are Christine L. and Anna B. Dorn, and the Ramsey County Board of Commissioners is the lienholder; and that it is furtl�er determined that the above described premises constitute hazardous buildings within the definition of Minnesota Statutes Section 463.15 for the following reasons: a. The exterior condition of the building is as follows: The rear porch, siding, cornice, window�s, doors and frames are decayed and rotted; the front porch is closed with rotted screens; the garage and barn are sagging, decayed and rotted throughout and the barn is out of plumb over one foot and is loade�i with debris; c. The interior condition of the single family dwelling is as follows : The first floor bedroom and bath have loose and falling plaster with rubbish being scattered throughout; the electric wiring throughout the house is in violation of the law and the plumbing, toilet and water heater are not working; d. The building in the above condition is beyond reasonable repair; e. The building is unfit for huma.n habitation in its present condition and the above corrections must be ma.de in compliance with the Building Code and the Housing Code of the City of Saint Paul in order to ma.ke the same habitable; f. The building constitutes a nuisance and a hazard to the public health, safety and welfare because of its physical dama.ge, dilapidation and inadequate ma.intenance; g. There is a garage and a barn on the premises that are sagging, decayed and rotted throughout; the barn is one foot out of plumb and is loaded with debris. now, therefore, be it RESOLVED, that in accordance with Minnesota Statutes Sections 463. 15 through 463.26, and based on the foregoing findings of the City Council, the Council of the City of Saint Paul does hereby ma.ke the following Order: ORDER 1. The owners of the above described property shall ma.ke the same safe and not detrimental to the public peace, health, safety, and welfare by having the said buildings and premises razed and the ma.terials therefrom removed from the premises within thirty (30) days from the date of the service of this Order: 2. Unless such corrective action is taken to comply with this Order or an answer served upon the City of Sain� Paul and filed in the office of the Clerk of District Court of Ramsey County, Minnesota, within twenty (20) days from the date of the ser�ice of this Order, a Motion for Summary Enforcement of this Order to raze and remove the said buildings will be ma.de to the Ramsey� . o��,N��.��,n���K �59245 ` • CITY OF ST. In the event that the buildings are to be razed by the City of Saint Paul pursuant to judgment of the District Court, all personal property or fixtures. which ma.y unreasonably interfere with the razing and removal of these buildings shall be removed within ten (10) days from the entry of judgment; and if not so removed, the City of Saint Paul shall remove and dispose of such personal property and fixt� es as provided by law; 4. If the City of Saint Paul is compelled to take any corrective action herein, all necessary costs expended by the City will be assessed against the above described real estate and collected as other taxes; and be it FURTHER RESOLVED, that a certified copy of this resolution and incorporated Order herein be served upon the last record owners of the above described property in the manner provided by law.
