Dear Councilmen:
On June 21 , 1972 the council laid over to July 5th a resolution, ratifying
assessment for the grading and surfacing with bituminous material the N-S alley
in Blk. 8, Lane's Phalen Grove Add. from ivy Ave. to Clear Ave. (G-1912) , and
referred this matter to the Public Works Department for a report on a complaint
made by Mr. David Johnson, 922 Clear Ave. , that a tree in the alley was
supposed to be removed and, because of this tree, cars are having problems
maneuvering in the alley and cause damage to his fence and garage.
On the afternoon of June 21 , 1972 I inspected this alley and contacted
Mr. David Johnson and discussed this matter with him. We both found that the
trunk of the tree is located almost entirely on private property owned by
Mrs. Dorothy S. Smith, 1331 Forest. This tree encroaches into the alley right-
of-way for a distance of 4 to 6 inches at the base of the tree. Nowever, the
limbs of this tree encroach more than halfway into the alleyway area. Mr.
Johnson felt that, if we could remove the limbs so that the trucks a�d cars
could use the entire alley surface, it would reduce his problem considerably.
With this in mind I contacted Mr. Lloyd A. Burkholder, Assistant Superin-
tendent of Parks, to trim back the branches to allow adequate vehicle movement
in the alley.
0� June 23, 1972 Mr. lloyd A. Burkholder wrote a letter to Mrs. Dorothy S.
Smith at 1331 Forest Ave. , calling this to her attention as owner of property
upon which the tree is located.
