F. No. 257671 approved Ma.rch 10, 1972, a public hearing was scheduled for 10:00 a.m. on Ma.rch 31, 1972, at which time said hearing was continued and ultimately held on May 30, 1972, before the Council of..the City of Saint Paul, said hearing pertaining to the condition of ,the structure located at 687 Jenks Street, Saint Paul, MinneSOta; and WHEREAS, upon facts presented at said hearing consisting of photographs, inspection reports and �he recommendations of the Building Department, it is found and determined by the City Council '� that according to the records and files in the office of the Ramsey County Abstract Clerk, the last record owner of the above described property is Robert P. Walsh and that there are no lien holders of record; and that it is further determined that the above described building constitutes a hazardous building within the definition of Minnesota Statutes Section 463. 15 for the following reasons: a. The exterior condition of the building is as follows: The lower part of th� chimney needs pointing; the front porch has rotted flooring, missing siding and a post is missing. Window sills are decaying. The entire structure has settled and is not level; c. The interior condition of the building is as follows: The five rooms on the first floor have the lath and plaster falling from the walls and ceilings. Windows and doors are broken and the floor boards are loose and buckled. Two thirds of the basement is used as an apartment. The floors are decayed and warped and plaster has fallen from the walls and ceilings. The floor joists are not sound. The plumbing pipes have been damaged by freezing. Plumbing, heating and electrical systems have been disconnected; d. The building in the above condition is beyond reasonable repair; e. The building is unfit for huma.n habitation in its present condition and the above corrections must be ma.de in compliance with the Building Code and the Housing Code of the City of Saint Paul in order to ma.ke the same habitable; f. The building constitutes a nuisance and a hazard to the public health, safety and welfare because of its physical dama.ge, dilapidation and inadequate maintenance; now, therefore, be it RESOLVED, that in accordance with Minnesota Statutes Sections 463. 15 through 463. 26, and based upon the foregoing findings of the City Council, the Council of the City of Saint Paul does hereby ma.ke the following Order: ORDER 1. Unless such corrective action is taken to comply with this Order or an answer served upon the City of Saint Paul and filed in the Office of the Clerk of the District Court of Ramsey County, Minnesota, within twenty (20) days from the date of the service of this Order, a Motion for Summary Enforcement of this Order to raze and remove the said building will be made to the Ramsey County District Court; 3. In the event that the building is to be razed by the City of Saint Paul pursuant to judgment of the District Court, all personal property or fixtures which may unreasonably interfere with the razing and removal of this building shall be removed within ten (10) days from the entry of judgment; and if not so removed, the City of Saint Paul shall remove and dispose of such personal property and fixtures as provided by' law; 4. If the City of Saint Paul is compelled to take any corrective action herein, all necessary costs expended by the City will be assessed against the above described real estate and collected as other taxes; and be it FURTHER RESOLVED, that a certified copy of this resolution and incorporated Order herein be served upon the last record owners of the abov� described property in_the ma.nner provided by law. The owners of record are James M. Hart - record owner and Robert P. Walsh - contract purchaser and the legal description of the is Lot 28, Block 14, Arlington Hills Addition. This building is dilapidated to such an extent that does not appear practical to restore it. At that time, your notice states, the above mentioned property may be repaired or wrecked and removed. This is to inform you that the undersigned has been acting as the attorney for Robert P. Walsh. The property at 687 Jenks Avenue, Saint Pau1, Minnesota, has been the subject of litigation between Mr. Robert P. Walsh and the owners of record, James M, and Gloria J. Hart. The trial in this ma.tter was concluded on February 1, 1972, and we are now waiting for the court's decision. For your reference, the caption of this action was Robert P.
