An ordinance amending the Zoning Code, Chapters 60
to 64, inclusive, of the Saint Paul Legislative Code,
pertaining to Use Districts , Height Distriets and Rezoning
of certain properties in the City of Saint Paul , as amended.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That the Zoning Code , Chapters 60 to 64, inclusive,
� of the Saint Paul Legislative Code , pertaining to Use Districts ,
Height Districts, and Rezoning of certain properties in the City
of Saint Paul, as amended� be and the same is hereby further amended
so as to rezone the following described property from "B" and Light
Industrial to "C!' Residenee District, to-wit :
Lots 1, 2, 5, 6, 7, 9, 10„ 11 and 12, Block 10, Kipp' s
Glen Terrace Addition to St. Paul. Al1 of Lots 1, 2,
3, 4, Block 11, Kipp ' s Glen Terrace Addition to St. Paul,
except that part of Lot 4 lying Southwesterly of the

Dear Sir:
This is written in response to the petition of William and Ada L. Schaefer
to rezone from f°B" and Light Industrial to "C" Residential property located
between Stewart Avenue and Shepard Road westerly of Glen Terrace. This property
is further described by the legal description on file.
This matter was heard at the September 7, 1972, Board of Zoning public
hearing. The staff report on file was read. The staff said it could see no
objection to the high density residential use of this property based upon
surrounding private land uses. The staff considered the alternative land uses
and noted the drawbacks to them.
The staff continued by pointing out that the big negative factor is the
access which is limited to two small frontages. One of these access points would
be undesirable because it adjoins a single family area. Because of this limitation,
the staff investigated the specific development proposal. The Traffic Engineer
was asked to respond to the proposed site plan and also to evaluate the impact of
the proposed development on traffic facilities. The Traffic Engineer's letter
was read as quoted on page 2 of the minut�s. The letter from the Fire Department
(quoted on page 3) reported that access should be provided at two points. The
staff pointed out that the Glen Terrace point could be restricted to emergency
use only. A letter from the Sewer Design Section of Public Works was read which
pointed out that the subject site is not served by sewer facilities and disclosed
that their construction is not scheduled until 1976 at the earliest. The letter
pointed out the method and cost of the developer building his own connection to
existing lines. A letter from the Traffic and Accident Section of the Police Dept.
was read which pointed out some of the same access problems.
The staff summarized that its investigation into the proposed development
disclosed that it was feasible. However, they also considered the possibility
of the present proposal being subsequently abandoned and replaced by a plan for
typical walk-up buildings. The staff decided that this too would be feasible as
long as the necessary portions of Glen Terrace and Stewart Avenues were vacated
concurrently with the rezoning. The staff emphasized that concurrent vacation
was essential or the City could be left with three separate "C" Residential parcels
with intolerable access problems.

Finally the staff pointed out that, although it found no insurmountable
short range problems with the high density residential use of the property, some
longer range problems could evolve. Two of these were mentioned by the Traffic
Engineer. One was the development of Elway Street to West 7th Street, which may
be assessed to owners of that frontage. The other was the increased pressure
to signalize the intersection of Elway and Shepard Road which is undesirable for
the expressway character of Shepard Road. Beyond this, the staff noted that the
development could interfere with future traffic facilities because of its
strategic location near intersections of major traffic corridors. The staff
concluded that refusing to rezone the property because of future potential
problems could be an easy way out, but that may not be wise unless there
is a consistant policy of keeping all intersections of major traffic corridors at
a low intensity use.
Mr. James Speckman, representing the petition, noted that the future of road
building was uncertain, so such speculation should not permanently bar development
of the site. He stated that the Traffic Department has always wanted to improve
Elway Street and this would help others besides his proposal. He said the access
via Glen Terrace would be for specific uses only and noted that the Traffic
Engineer did not seem alarmed by the traffic routing.
Several residents of the area north of the subject site appeared voicing
their concern over the nuisance traffic in their neighborhood at present and
expressing their fears that this situation would get worse.
As the Board discussed this matter, it was noted that the intersection of
Elway and Shepard Road is dangerous at present and needs traffic signals even
without the proposed development. The Board discussed the traffic condition on
Elway and speculated on alternative ways of gaining access between West 7th and
Shepard Road. They noted that the nuisance traffic mentioned by the area residents
was generated by Webb Publishing Company.
Subsequently, the Board heard a motion to recommend denial because of the
effect on the health, safety and welfare of the people in the area and until a
better traffic condition can be figured out. The seconding motion noted the
traffic problem had not been solved and the rezoning would add to it. It stated
this was not the proper location for an apartment development of this size. An
argument against the motion stated that there were traffic problems but that
reasonable solutions to them have been given and the Planning Board could see
that some of the problems are solved. The motion to recommend denial carried by
avoteof3tol.
The official response of the Bureau of Valuations to the feasibility of
vacating G1en Terrace and Stewart Avenue was not available for the Board meeting.
The Bureau notes that not all reporting offices have responded, but the Bureau
hopes to have a tentative recoaunendation before the Council at the time of the
public hearing.

A. SUFFICIENCY: In a letter dated August 18, 1972, the Department of Finance

B. HISTORY: There is no zoning history for this site.
C. PROPOSED USE: The petition declares the proposed use to be "multiple dwelling".
A representative of this development has stated the proposal is for 200
dwelling units of "luxury" apartments in a single 22 story building with
internal and external parking.
D. FRONTAGE AND AREA: Before vacation of those portions of Glen Terrace and
Stewart Avenue as required to develop the property as presently proposed; the
subject property i� in three parts. These parts have cumulative frontages on
�len Terrace of approximately 930 ft. and on Stewart Avenue of about 700 ft.
After vacation of those portions, the site would have a frontage of about
690 ft. along Shepard Road and irregular frontages along Elway St. of about
190 ft. and along Glen Terrace of about 200 ft. �
The area of the subject site at present is 170,816 sq. ft. Subsequent street
vacations could increase the site area to 225,466 sq. ft. or 5.17 acres.
E, AREA ZONING: Property adjoinino to the southwest is zoned Light Industrial.
Prope?�ty adjoining to the northwest is "B" Residential beyond which is
Commercial zoning along West 7th Street. A Co�nercial district exists at the
southeast corner of Montreal Avenue and Elway Street. Property adjoining on
the north and east across Elway is "B" Residential as is a small strip of
land across Shepard Rd, beyond which is "Unassigned" property.
F, COMPREHENSIVE PLAN: Apparently because of the severe topology of the site,
the Comprehensive Plan recommended open space for the area between Stewart
Avenue and the railroad tracks with Limited Industrial use south of Stewart
Avenue to Shepard Road.

G. SITE CONDITIONS: The �ite slopes significantly downward to the southeast and
is quite wooded. It is presently occupied by eight single family homes in
fair to good condition. One house is new and in very good condition. Only a
a portion of Stewart Avenue is improved while Glen Terrace is improved through-
out the site in a narrow right-of-way. The existing homes are located on large
parcels much of which can be considered vacant, not being maintained for yard
purposes.
H. AREA CONDITIONS: The M�lwaukee Road Fcrd plant spur track is nearby to the
north of the site and at a higher elevation. Elway Street with its intersection
to Shepard Road adjoins the site to the east. Shepard Road adjoins the site
on the southeast and a large parking lot for Webb Publishing Company adjoins
the site to the west. Beyond the railroad tracks is a residential area with
single family homes and some vacant lots. West 7th Street frontage is
developed residentially near Montreal with some commercial uses. I-35E is
one block east of the subject site with no interchange with Shepard Road.
Across Shepard Road is open space. Industrial uses predominate beyond the
Webb Publishing building. A small bluff exists north of the site which,
in part, accounts for awkward street platting in that area.

on Glen Terrace because o� the trafPic involved. Glen Terrace is a
very narrow, windin� street, We already have more traffic Fro�n Webb
Publishin� Company than the street can. hand7.e and in the winter only
one car can pass and wit,h an additional 200 cars, there would be no
way possible to handle the situation, not to mention the possibility
of theft, etc., which we do not have naw. We already have enough
reckless drivers and an additional 10�0 of the 200 more cars would
make it virtually unsafe �or us to back out of our driveways and
most oi' a11, it would also be very unsafe for the children on our
