Paul Legislative Code, pertaining to Use
Districts, Height Districts and Rezoning

Paul, as amended.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDiAIN:
Section l. That the Zoning Code, Chapters 60 to 64,
inclusive, of the Sain t Paul Legislative Code, pe�taining to
Use Districts, Height Districts and Rezoning of certain prop-
erties in the City of Saint Paul, as amended, be and the same
is hereby further amended so as to rezone the following des-
cribed property from "A" Residence Dis trict to Commercial
District, to-ws.t:
Lots 32, 33, 34, 35, 36, 37, and 38,
Block 3, Hayden Height5 Addition;
situate on property located on the east side of White Bear Avenue
between East Nebraska and East Nevada.
Section 2. This ordinance shall take effect and be in force
thirty (30) days from and after its passage, approval and
publication.

A, SUFFICIENCY: In a letter dated July 19, 1972, the Finance Department declared
the petition sufficient with the owners of 13 or 72% of 18 parcels eligible
having signed the petition.
B. HISTORY: An attempt was made in 1958 to rezone the northern three lots of
this site which consists of seven platted lots. That attempt received a
recommendation of denial from the Board after which several petition signers
removed their names from the petition which was declared insufficient before a
Council hearin� was conducted.
C. PROPOSED USE: The petition declares the proposed use to be a sit-down type
restaurant.
D. FRONTAGE AND AREA: The site has a frontage of 267.96 feet along White Bear
Avenue and of 130 feet along Nevada and Nebraska Avenues for an area of
�4,834.8(? sq, ft.
E. AREA ZONING: The block face across White Bear Avenue is zoned Commercial as
is thie remainder of White Bear Avenue frontage north of this site. This
uistrict t�nds to widen as it nears Larpenteur Avenue. The Cc+rnmercial district

This is written in response to the petition of Vernon R. Colon to rezone
from "A" Residential to Commercial property located on the east side of White
Bear Avenue between East Nebraska and East Nevada. This property is further
described as: Lots 32, 33, 34, 35, 36, 37, and 38, Block 3, Hayden Heights
Addition.
This matter was heard at the August 17, 1972, Board of Zoning public hear-
ing at which time the staff report on file was read. The staff said their
preferred arrangement would be to discourage elongated strip zoning along White
Bear Avenue, in favor of a commercial center. The staff noted that the Public
Library is contemplating purchasing a comparable area in the next block south
of the subject site. Under the preferred arrangement, the staff said the
library branch should be located on the subject site as a transition between
the cotrnnercial uses to the north and the residential uses to the south. However,
if the library does not take the subject site, it would be better to rezone it to
commercial than to expect residential development between the commercial uses
and the library.
The staff said they talked to Mr. Eggen of the Library who said he could be
jnst as interested in this site as in the one he had been contemplating, especially
if he could get a lower valuation. The staff said they asked the Bureau of
Valuations for a figure and they unofficially quoted a figure, based upon "A"
Residential zoning, of $5,000 less than the site presently contemplated for the
library branch.
The petitioner stated the total development would be approximately $250,000
and would employ 35 to 40 people. He said the people in the neighborhood were
in favor of it provided certain conditions were met. He said it would not be a
fast-food establishment and would have no liquor. He indicated he would not be
willing to await further investigation by the library.
A nearby resident of the site presented a list of conditions he and his
neighbors wanted placed on the proposal.

As the Board discussed this, they noted that requirements imposed by various
City departments at the time of the parking lot permit may change the conditions
requested by the neighborhood residents. Subsequently, a motion was heard to
recommend approval. The motion was seconded and carried by a vote of 4 to 0.
After the vote, a member of the audience raised objections to the pro-
posal but was ruled out of order since the vote was already completed, and
was told that anyone could oppose this matter during the Council hearing at
the appropriate time.
