In the matter of hazardous
buildings being that 12 story frame
dwelling and frame garage known and
described as 1347 Rice Street in
the City of Saint Paul and situated
upon those premises legally described
as Lot 21, Block 13, Hager s subdi-
vision of Walcotts Addition, according to
the plat on file and of record in the
office of the Register of Deeds in and
for the County of Ramsey, State of
Minnesota.
WHEREAS, pursuant to resolution, C. F. No. 258589, approved
May 10, 1972, a public hearing was scheduled for 10:00 a.m. on
June 13, 1972 before the Council of the City of Saint Paul, said
hearing pertaining to the condition of the structures located at
1347 Rice Str�et, Saint Paul, Minnesota; and
WHEREAS, upon facts presented at said hearing consisting of
photographs, inspection reports and the recommendations of the
City Building Department, it is found and determined by the City
Council tliat according to the records and files in the office of
the Ramsey County Register of Deeds, the last record owners are
Wilbert P. and Mary Lou Buettner; and that there are no lien
holders of record; and that it is further determined that the above
described buildings constitute hazardous buildings within th e
definition of Minnesota Statutes Section 463.15 for the following
reasons:
a. The buildings are standing vacant, abandoned
and are subject to being entered by unauthorized persons;

b. The exterior condition of the building is
as follows : The porch of the house has been vandalized
and part of it is torn down. The roof has holes due to
a fire. Part of the wood siding has been removed and
part of the chimney is missing;
c. The interior condition of the building is
as follows: The first floor is badly vandalized,
windows and doors are torn out and plaster is broken
from the walls. Part of the stairs to the second floor
has been removed. The basement has a six foot ceiling
height and a fire has badly charred the structural
members. The plumbing, heating and electrical systems
have been vandalized;
d. The 16' x 22' garage is dilapidated and in
a hazardous condition;
e. The buildings in the above condition are
beyond reasonable repair;
f. The buildings are unfit for human habitation
in their present condition and the above corrections must
be made in compliance with the Building Code and the
Housing Code of the City of Saint Paul in order to ma.ke
the same habitable;
g. The buildings constitute a nuisance and a
hazard to the public health, safety and welfare because
of £heir physical damage, dilapidation and inadequate
ma.intenance;
now, therefore, be it :
RESOLVED, that in accordance with Minnesota Statutes Sections
463. 15 through 463.26, and based upon the foregoing findings of the
City Council, the Council of the City of Saint Paul does hereby
ma.ke tlie following order:
ORDER
�. The owner of the above described building shall ma.ke the
same safe and not detrimental to the public peace, health, safety
and welfare by having the said building razed and the ma.terials there-
from removed from the premises within thirty (30) days from the date
of the service of this Order.
2. Unless such corrective action is taken to comply with this
Order or an answer served upon the City of Saint Paul and filed in
the Office of the Clerk of the District Court of Ramsey County,
Minnesota, within twenty (20) days from the date of the service of
this Order, a Motion for Summary Enforcement of this Order to raze
and remove the said buildings will be made to the Ramsey County
District Court.

3. In the event that the buildings are to be razed
by the City of Saint Paul pursuant to judgment of the District
Court, all personal property or fixtures which may unreason-
ably interfere with the razing and removal of these buildings
shall be removed within ten (10) days from the entry of judgment
and if not so removed, the City of Saint Paul shall remove and
dispose of such personal property and fixtures as provided by
law;
4. If the City of Saint Paul is compelled to take any
corrective action herein, all necessary costs expended by the
City will be assessed against the above described real estate
and collected as other taxes; and be it
FURTHER RESOLVED, that a certified copy of this resolution
and incorporated Order herein be served upon the last record
owners of the above described property in the manner provided
by law.

Gentlemen:
The Bureau of Public Buildings is hereby submitting its report on
the condition of the structures at the above location.
The owners of record are Wilbert P. and Mary Lou Buettner and the
legal description of the property is Lot 21, Block 13, Hager' s Sub
of Walcott' s Addition.
The structures on this property are a lZ story frame dwelling and
a 16 ' x 22 ' frame garage.
The porch of the house has bean vandalized and part of it is tarn
down. The roof has holes due to a fire. Part of the wood siding
has been removed. Part of the chimney is missing.
The basement has a six foot ceiling height and a fire has badly
charred the structural members .
The first floor is badly vandalized, windows and doors torn out
and plaster broken from the walls. Part of the stairs to the se-
cond floor has been removed.
The plumbing, heating and electrical systems �,ave been vandalized.
�he 16 ' x 22 ' frame garage is dilapidated and in a hazardous
condition.
The subject property has been boarded up by the city since October
26 , 1971.

The Housing and Redevelopment Authority is not in the process
of �quiring or intending to acquire this property.
Inasmuch as the conditions outlined above constitute a public
hazard and the owner has made no attempt to satisfactorily re-
pair the damage despite our warnings, and the continued vacant
and boarded up condition contributes a blighting effect on the
neighborhood, it is the recommendation of this bureau that this
matter be referred to the City Attorney's office for razing and
removal through District Court Proceedings.
